Venue in Kansas depends on residence and real property. Proceedings for probate of a will or administration are brought in the decedent's county of residence if the decedent owned real property there; if the decedent did not own real property in the residence county, the case may be brought in the residence county or in any Kansas county where the decedent owned real property; for a nonresident, probate may be brought in any Kansas county where estate property is to be administered. If competing cases are filed, the first-filed proceeding controls while venue is decided, and a case filed in the wrong county is transferred rather than dismissed (K.S.A. 59-2203).

The jurisdiction process

  1. Start in the right county. For Wichita County, file at the Wichita County Courthouse in Leoti with the clerk of the district court (K.S.A. 20-343), not in the city of Wichita. Gather the death certificate, the will if one exists, asset information, debt information, and real estate title documents.
  2. Check the will deadline before anything else. A will of a Kansas resident cannot pass property unless a petition for probate is filed within six months after death (K.S.A. 59-617). If the family is not ready to open an estate, Kansas allows filing a will and affidavit, including a copy of the will, to preserve it for later probate (K.S.A. 59-618a).
  3. Choose the Kansas route. The small estates affidavit is for qualifying personal property and is presented to the holder, such as a bank, under K.S.A. 59-1507b. Wichita County court filings may include refusal to grant letters (K.S.A. 59-2287), determination of descent after the required time has passed (K.S.A. 59-2250), informal administration (K.S.A. 59-3301), or a request for simplified administration or supervised administration, which the court decides under K.S.A. 59-3202.
  4. Prepare the petition. A petition for administration or probate of a will is drafted from the Kansas Probate Code requirements, including K.S.A. 59-2219 or K.S.A. 59-2220. If you want simplified administration, ask for it in the petition and give reasons, because the court decides that request at the hearing (K.S.A. 59-3202).
  5. Add the required filing documents. A new case needs a case-filing cover sheet, and a self-represented filer must include the Self-Represented Litigant Certification Form. If you cannot pay the $131.50 filing fee as of August 2026, including the $109.50 amount and $22 surcharge through June 30, 2030, ask the court about the Poverty Affidavit process (K.S.A. 59-104).
  6. File in Leoti. A self-represented filer may file in person, by mail to P.O. Box 968, Leoti, KS 67861, by fax to 620-375-2999, or by the Wichita County drop box. A drop-box filing made by 4:00 pm local Central Time counts as filed that day. Attorneys must use e-filing under Rule 122 (Kan. Sup. Ct. R. 122).
  7. Wait for the court to set the hearing. Kansas requires the court to fix the time and place for a hearing on a petition for probate of a will, administration, or refusal to grant letters (K.S.A. 59-2222).
  8. Give notice. Hearing notice is published once a week for three consecutive weeks, with the mailing required within seven days after first publication and the hearing set after the publication window under K.S.A. 59-2209. The petitioner also gives notice to creditors within 30 days after filing as ordered by the court (K.S.A. 59-709).
  9. Attend the hearing or request permission to appear by phone or video. Remote appearance is discretionary under Rule 103 (Kan. Sup. Ct. R. 103), and the Kansas Judicial Council publishes a motion form for that request.
  10. Receive authority from the court if administration is opened. If the will is admitted and an executor can serve, the court grants letters testamentary (K.S.A. 59-701). If there is no will, the court grants letters of administration to an administrator (K.S.A. 59-705).
  11. Administer the estate. The personal representative files the inventory and valuation within 30 days after the letters unless the court allows more time (K.S.A. 59-1201), gives actual notice to known or reasonably ascertainable creditors, pays allowed debts and taxes, and manages estate assets. Claims are barred unless presented within the later of four months from first publication or 30 days after actual notice to the creditor, subject to the nonclaim rule (K.S.A. 59-2239).
  12. Close the case. When the estate is ready, the personal representative files a petition for final settlement and accounting. The court's final decree assigns the estate, and if real estate is involved, a certified copy is entered on the county clerk's transfer record (K.S.A. 59-2247; K.S.A. 59-2249).
