Which court handles jurisdiction

Elk County probate is filed with the clerk of the district court in Howard, not at the larger district office in El Dorado. Elk County shares Kansas's 13th Judicial District with Butler and Greenwood counties under K.S.A. 4-214, but K.S.A. 20-343 keeps a clerk of the district court in each county, so an Elk County filing stays at the Elk County Courthouse.

Venue is governed by K.S.A. 59-2203. If the decedent was a Kansas resident and owned real property in the county of residence, file in that county. If the decedent did not own real property in the county of residence, filing may be in the county of residence or in any county where the decedent owned real property. For a nonresident, filing may be in any Kansas county where estate property is to be administered. If proceedings are started in more than one county, the first-filed case controls while venue is sorted out, and the file is transferred if another county is the proper venue.

The jurisdiction process

  1. Gather the death certificate, the will if one exists, asset information, debts, tax information, and real estate documents. If the person died a Kansas resident, decide before six months from death whether a petition to probate the will must be filed or whether the will or a copy should be preserved by filing a will and affidavit under K.S.A. 59-618a, because K.S.A. 59-617 controls whether the will can pass property.
  2. Choose the Kansas path that fits the assets. A small estates affidavit under K.S.A. 59-1507b is furnished to the holder of personal property. A refusal to grant letters under K.S.A. 59-2287, a determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration under K.S.A. 59-3202 requires a court filing.
  3. Prepare the petition required for the route. If you want simplified administration, ask for it in the petition and give reasons, because the court decides under K.S.A. 59-3202. A new case also needs the statewide case-filing cover sheet, and a self-represented filer must include the Self-Represented Litigant Certification Form.
  4. File with the clerk of the district court in Elk County under K.S.A. 20-343. You may file at the Howard courthouse, mail papers to P.O. Box 306, Howard, KS 67349, fax them to 620-374-3531 with the Rule 119 fax transmission sheet, or use the courthouse drop box. The drop box is collected each weekday at 8:00 a.m.; a filing deposited by 4:00 p.m. local time is treated as filed that day under the statewide rule.
  5. Pay the $131.50 docket fee for a probate estate for filings on and after July 1, 2026, under K.S.A. 59-104, unless you file a Poverty Affidavit under K.S.A. 59-104 and the court permits a waiver or deferral.
  6. The court fixes the hearing under K.S.A. 59-2222. If publication notice is required, publish once a week for three consecutive weeks under K.S.A. 59-2209, mail required copies within the statutory time, and include the petition, attachments, and will when required.
  7. Handle creditor notice. The petitioner gives notice to creditors under K.S.A. 59-709, and claims are governed by the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor under K.S.A. 59-2239.
  8. If there is a surviving spouse, send the required elective-share notice materials within the Kansas probate process under K.S.A. 59-2233. Do not ask court staff to choose the spouse's rights or fill out legal strategy for you.
  9. At the hearing, the court decides whether to admit the will, appoint the fiduciary, grant letters testamentary under K.S.A. 59-701, or grant letters of administration under K.S.A. 59-705. The clerk receives filings and fees, but the court grants the authority.
  10. After letters are granted, file the inventory and valuation within 30 days as required by K.S.A. 59-1201, unless the court allows more time. The personal representative then collects assets, handles claims, pays allowed debts and taxes, and keeps estate records.
  11. Close the estate by filing the petition for final settlement and asking the court for the final decree assigning the estate. Where real estate is assigned, follow the Kansas transfer-record steps tied to the final decree under K.S.A. 59-2249.

Kansas publishes free statewide forms through the Kansas Judicial Council, but Elk County does not publish a local probate petition, local probate checklist, or Elk County-specific probate cover sheet.
