Which court handles jurisdiction
Probate for Smith County is filed with the clerk of the district court at the Smith County Courthouse in Smith Center, in the Smith County District Court. Smith County shares Kansas's 17th Judicial District (K.S.A. 4-218) with Decatur, Graham, Norton, Osborne, and Phillips counties, but K.S.A. 20-343 places a clerk of the district court in each county. The jurisdiction process
- Gather the death certificate, the will if one exists, and a first list of assets and debts. Kansas has a six months rule for a resident decedent's will: a will cannot pass property unless a petition to probate it is filed within six months after death, unless a statutory savings route applies (K.S.A. 59-617).
- If the family is not ready to open a full estate, ask whether filing a will and affidavit under K.S.A. 59-618a should be used to preserve the will. Kansas allows the will or a copy to be filed with that affidavit, and filing inside the six months period under K.S.A. 59-617 can preserve the will for later probate (K.S.A. 59-618a).
- Choose the local filing path. The small estates affidavit under K.S.A. 59-1507b is a noncourt transfer tool for personal property and is furnished to the holder of the property. Court routes can include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration under K.S.A. 59-3202.
- Prepare the verified petition if a Smith County court case is needed. A petition for administration or probate of a will must follow Kansas statutory requirements, and if you want simplified administration you must ask for it and give reasons under K.S.A. 59-3202.

- Give hearing notice as ordered. When K.S.A. 59-2209 notice is required, publication runs once a week for three consecutive weeks, the first publication must be within 30 days after the order, and mailing to listed heirs, devisees, and legatees must occur within 7 days after first publication with required papers attached (K.S.A. 59-2209). Notice to creditors must be given within 30 days after filing the petition under K.S.A. 59-709.
- If there is a surviving spouse, send the required elective-share notice within 10 days when K.S.A. 59-2233 applies.
- Attend the hearing unless the court allows a remote appearance under Kan. Sup. Ct. R. 103. After the hearing, the court may admit the will and grant letters testamentary to an executor under K.S.A. 59-701, or grant letters of administration to an administrator under K.S.A. 59-705.
- After letters are granted, file the inventory and valuation within 30 days unless the court grants more time (K.S.A. 59-1201). Publish and mail notices, handle claims under the later-of rule in K.S.A. 59-2239, pay debts and taxes, and keep records for the estate.
- Close the estate by petitioning for final settlement and accounting. The court's final decree assigns the estate, and when real estate is involved the decree is entered on the county clerk's transfer record as Kansas law requires (K.S.A. 59-2247, 59-2249).
