Before you file anything in Rush County, make a working list of the decedent's accounts, debts, real estate, vehicles, insurance, retirement accounts and beneficiary designations. Probate for Rush County is filed in La Crosse with the clerk of the district court appointed for Rush County (K.S.A. 20-343). Rush County is in Kansas's 24th Judicial District with Edwards, Pawnee, Hodgeman, Ness and Lane counties (K.S.A. 4-225), but that district grouping does not move a Rush County filing to another county.
Venue in Kansas depends on residence and real property. If the decedent lived in Kansas and owned real property in the county of residence, file in that county. If the decedent lived in Kansas but did not own real property in the county of residence, Kansas allows filing in the county of residence or in a county where the decedent owned real property. The jurisdiction process
- Start with the death certificate, the will if one exists, and a list of assets and debts. If the decedent was a Kansas resident and left a will, decide within six months whether to file a petition to probate it, or at minimum file the will or a copy with an affidavit to preserve it (K.S.A. 59-617; K.S.A. 59-618a).
- Choose the Kansas route that fits the assets. The small estates affidavit under K.S.A. 59-1507b is for personal property when the probate assets do not exceed $75,000 as of July 1, 2023. Other possible court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
- Prepare the petition if a court case is needed. A petition for administration or probate of a will follows the Kansas statutory content rules, and if you want simplified administration you must ask for it and give reasons (K.S.A. 59-2219; K.S.A. 59-2220; K.S.A. 59-3202).
- Add the statewide case filing cover sheet. If you are filing without a lawyer, add the Self-Represented Litigant Certification Form. If you cannot afford the filing fee, ask about the Poverty Affidavit under K.S.A. 59-104.
- File with the clerk of the district court in Rush County at the La Crosse courthouse or by mailing the papers to PO Box 387, La Crosse, KS 67548 (K.S.A. 20-343). A self-represented filer may also file by fax to 785-222-2748 or use the courthouse drop box; a drop box filing deposited by 4:00 p.m. local time counts that day under the Kansas filing rule.
- Pay the filing fee. As of August 2026, a probate estate filing in Rush County is $131.50, which is the $109.50 statutory fee plus the $22 surcharge under K.S.A. 59-104.

- Give notice as ordered. Hearing notice is published once a week for three consecutive weeks, and the mailed notice goes to heirs, devisees and legatees with the petition and will when required (K.S.A. 59-2209). The petitioner also gives notice to creditors within 30 days after filing the petition under K.S.A. 59-709.
- Attend the hearing. The court, not the clerk, admits the will and grants letters testamentary to an executor when appropriate (K.S.A. 59-701), or grants letters of administration when there is no will or no executor can serve (K.S.A. 59-705).
- After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Give required notices, collect assets, handle claims, pay allowed debts and taxes, and keep records for final settlement.
- Track the creditor period carefully. A demand is barred unless it is presented within the later of four months from first publication or, for a known or reasonably ascertainable creditor who receives actual notice, 30 days after that notice (K.S.A. 59-2239).
- Close with the petition for final settlement and the court's final decree assigning the estate. If real estate is assigned, the decree is handled for the county clerk's transfer record as Kansas law requires (K.S.A. 59-2247; K.S.A. 59-2249).
