If the decedent was a Kansas resident and there is a will, decide before six months after death whether to petition to probate it, because a will cannot pass property unless a petition is filed within six months after death or a statutory saving step applies (K.S.A. 59-617).
  2. If the family is not ready to open a full estate, consider preserving the will by filing a will and affidavit, including the will or a copy, in the district court of the decedent's last residence within six months after death (K.S.A. 59-618a; K.S.A. 59-617). Ask the clerk which fee line applies, because the statewide chart includes both a $70.50 filing a will and affidavit line as of August 2026 and a no-fee filing a will after death line (K.S.A. 59-104).
  3. Choose the path. Kansas options include the small estates affidavit for personal property under K.S.A. 59-1507b when the statutory conditions fit, refusal to grant letters under K.S.A. 59-2287, determination of descent after the required time under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration as the court decides under K.S.A. 59-3202.
  4. Prepare the petition if a court case is needed. A petition for administration or for probate of a will is drafted from Kansas statutory requirements, and if you want simplified administration you ask for it and give reasons for it (K.S.A. 59-2219; K.S.A. 59-2220; K.S.A. 59-3202).
  5. Add the statewide case-filing cover sheet. If you are representing yourself, add the statewide Self-Represented Litigant Certification Form. If you cannot afford the docket fee, ask about the Poverty Affidavit procedure for probate fees (K.S.A. 59-104).
  6. File with the Nemaha County clerk of the district court in Seneca (K.S.A. 20-343).   7. The court fixes the hearing after the petition is filed. The judge, not the clerk, decides whether to admit the will, appoint the executor or administrator and grant letters testamentary or letters of administration (K.S.A. 59-2222; K.S.A. 59-701; K.S.A. 59-705).
  8. Give notice as ordered. Kansas hearing notice is published once each week for three consecutive weeks, and the mailed notice must include the petition, attachments and the will when applicable (K.S.A. 59-2209). The petitioner also gives notice to creditors within the statutory publication period (K.S.A. 59-709).
  9. If there is a surviving spouse, send the required elective-share notice within the statutory time after qualification, a refusal petition or a filing a will and affidavit step, as applicable (K.S.A. 59-2233; K.S.A. 59-618a; K.S.A. 59-2287).
  10. After letters are granted, the personal representative files the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Creditor claims are governed by the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239).
  11. Pay allowed debts, expenses and taxes, then ask the court for final settlement. The court's final decree assigns the estate, and real estate matters may require transfer-record steps after the decree (K.S.A. 59-2247; K.S.A. 59-2249).
