Which court handles jurisdiction

Probate for Russell County is filed with the clerk of the district court at the Russell County Courthouse in Russell, not at another county's filing counter. Russell County is in Kansas's 20th Judicial District under K.S.A. 4-221, along with Barton, Ellsworth, Rice, and Stafford counties, but K.S.A. 20-343 provides for a clerk of the district court in each county.

Kansas venue is not simply the county where a person lived. Proceedings for probate of a will or administration belong in the county of the decedent's residence if the decedent owned real property there. If the decedent did not own real property in the county of residence, venue can be the county of residence or a county where the decedent owned real property. For a nonresident decedent, venue can be a Kansas county where the decedent left estate to administer. The first properly started case controls, and a case filed in the wrong county is transferred to the proper county rather than dismissed (K.S.A. 59-2203).

The jurisdiction process

  1. Collect the death certificate, the will if one exists, asset information, creditor information, and any real estate details before choosing a path. A Kansas will of a resident decedent must be the subject of a probate petition within six months after death, or it cannot pass property unless a statutory savings provision applies (K.S.A. 59-617).
  2. If the family is not ready to open a full estate but needs to preserve a will, ask about filing a will and affidavit under K.S.A. 59-618a. Kansas also has other statewide paths, including the small estates affidavit for personal property under K.S.A. 59-1507b, refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified administration or supervised administration under K.S.A. 59-3202.
  3. Prepare the petition for the route you are using. If you want simplified administration, the petition must ask for it and give reasons. A self-represented new case also needs a case-filing cover sheet and the Self-Represented Litigant Certification Form.
  4. File with the Russell County clerk of the district court at 401 N Main Street in Russell, by mail to PO Box 876, Russell, KS 67665-0876, by fax to 785-483-2448, or in the courthouse drop box. A self-represented drop-box filing made by 4:00 p.m. local time counts that day. Pay the $131.50 probate estate filing amount for filings on and after July 1, 2026 through June 30, 2030 under K.S.A. 59-104, or file a Poverty Affidavit under K.S.A. 59-104 if you are asking the court to waive or defer the fee.
  5. The court fixes the hearing after a petition for probate of a will, administration, or refusal to grant letters is filed. Notice is published once per week for three consecutive weeks, the first publication must be within 30 days after the order setting the hearing, and mailed notice to heirs, devisees, and legatees must go out within 7 days after first publication with the petition and will included unless the court orders otherwise (K.S.A. 59-2209).
  6. The petitioner also gives notice to creditors under K.S.A. 59-709, and known or reasonably ascertainable creditors receive actual notice. If there is a surviving spouse, the required elective-share notice is mailed within 10 days under K.S.A. 59-2233.
  7. Attend the hearing in Russell County unless the judge allows a phone or video appearance under Kan. Sup. Ct. R. 103. The court, not the clerk, admits the will and grants letters testamentary to an executor under K.S.A. 59-701 or letters of administration to an administrator under K.S.A. 59-705.
  8. After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Publish and mail required notices, manage claims, pay valid debts and taxes, and keep records for the estate.
  9. Claims are governed by the nonclaim statute in K.S.A. 59-2239. A demand is barred unless presented within the later of four months from the first published notice or 30 days after actual notice to a known or reasonably ascertainable creditor. K.S.A. 59-2239 also has a separate six month rule tied to creditor claims and liens when no petition was filed within the six month period after death, distinct from the will rule in K.S.A. 59-617.
  10. To close, file the petition for final settlement and accounting. The court enters the final decree assigning the estate, and if real estate is assigned, the decree is entered on the county clerk's transfer record as required by K.S.A. 59-2247 and K.S.A. 59-2249.
