The jurisdiction process
- Find the death certificate, the will if there is one, account information, deeds, vehicle titles and debt information. If the will may need to control property, decide within six months of death whether to petition to probate it, because Kansas's six months rule under K.S.A. 59-617 can keep the will from passing property if no savings step applies.
- Choose the Kansas route before preparing papers. A small estates affidavit under K.S.A. 59-1507b is presented to the bank or other holder and is not opened as a court case. Court routes can include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250 after the required time, filing a will and affidavit under K.S.A. 59-618a to preserve a will, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration decided by the court under K.S.A. 59-3202.
- Prepare the petition required for the route. If you want simplified administration, ask for it in the petition and give reasons because the court decides under K.S.A. 59-3202. Add the case-filing cover sheet and, if you are representing yourself, the Self-Represented Litigant Certification Form.
- File with the clerk of the district court at the Wabaunsee County Courthouse in Alma under K.S.A. 20-343. A self-represented filer may file in person, by mail to PO Box 278, by fax, or in the courthouse drop box by 4:00 p.m. local time. Pay the $131.50 probate estate docket fee, effective July 1, 2026, under K.S.A. 59-104, or file a Poverty Affidavit under K.S.A. 59-104 if you are asking the court to waive the fee.

- After letters are granted, file the inventory and valuation within 30 days after the letters unless the court allows more time (K.S.A. 59-1201). Give actual notice to known or reasonably ascertainable creditors, track claims under the later-of rule in K.S.A. 59-2239, pay allowed debts and taxes, and keep estate settlement records for the final accounting.
- To close, file the petition for final settlement and accounting. The court's final decree assigns the estate under K.S.A. 59-2247 and K.S.A. 59-2249, and real estate assignments may require the certified decree to be entered with the county clerk's transfer materials.
