- If the family is not ready to open a full estate, ask whether filing a will and affidavit under K.S.A. 59-618a would preserve the will within the six months period required by K.S.A. 59-617. A copy can be used for that preservation filing if the statutory affidavit says whether the original or a copy is being filed.
- Choose the Kansas path. A small estates affidavit under K.S.A. 59-1507b is furnished to the holder of personal property and is not a court filing. Court paths can include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration under K.S.A. 59-3202.
- Prepare the petition from the Kansas Probate Code requirements. If you want simplified administration under K.S.A. 59-3202, ask for it in the petition and give reasons. A new case also needs the statewide case-filing cover sheet, and a self-represented filer needs the Self-Represented Litigant Certification Form.
- File with the clerk of the district court under K.S.A. 20-343 at 108 N 1st St. in Westmoreland, by mail to PO Box 129, Westmoreland, KS 66549, by fax to 785-457-2107, or through the courthouse drop box. - To close, file the petition for final settlement and accounting. The court enters the final decree assigning the estate under K.S.A. 59-2247 and K.S.A. 59-2249. If real estate is assigned, the decree is handled with the county clerk's transfer record as required by K.S.A. 59-2249.
