The jurisdiction process

  1. Gather the death certificate, the will if there is one, account information, vehicle titles, deeds and debts. If the decedent died a Kansas resident with a will, decide quickly whether to petition for probate of the will or at least file the will or a copy with an affidavit, because the six-month rule in K.S.A. 59-617 can keep a will from passing property if no saving step applies.
  2. Choose the Kansas route before drafting. The small estates affidavit under K.S.A. 59-1507b is for qualifying personal property and is given to the bank or holder, not filed as a court case. Court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, filing a will and affidavit under K.S.A. 59-618a, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
  3. Prepare the verified petition for the route you are using. If you want simplified administration under K.S.A. 59-3202, ask for it in the petition and give reasons. Add the case-filing cover sheet and, if you are filing without a lawyer, the Self-Represented Litigant Certification Form.
  4. File with the Haskell County clerk of the district court, K.S.A. 20-343, at 300 S Inman in Sublette, by mail to PO Box 146, Sublette, KS 67877, by fax to 620-675-8599 with the Rule 119 fax transmission sheet, or by courthouse drop box by 4:00 p.m. local time. For probate of an estate or will, pay $131.50 current as of July 1, 2026, under K.S.A. 59-104, or file a Poverty Affidavit under K.S.A. 59-104 if you are asking the court to excuse the fee.
  5. The court fixes the hearing after the petition is filed, K.S.A. 59-2222. If you need to appear by phone or video, file the Kansas Judicial Council motion for a remote appearance under Rule 103 and notify the other parties as required by Kan. Sup. Ct. R. 103.
  6. Give notice as ordered. Hearing notice is published once each week for three consecutive weeks, and the first publication, mailing, attachment and hearing-date rules come from K.S.A. 59-2209. Notice to creditors must be handled under K.S.A. 59-709, and the creditor claim period is governed by the later-of rule in K.S.A. 59-2239.
  7. If there is a surviving spouse, send the required elective-share notice within 10 days when K.S.A. 59-2233 applies. Do not assume family agreement removes a statutory notice duty.
  8. At or after the hearing, the court admits the will if appropriate, appoints the executor or administrator, and grants letters testamentary under K.S.A. 59-701 or letters of administration under K.S.A. 59-705. The clerk accepts filings and collects fees, but the court grants the authority.
  9. After letters are granted, file the inventory and valuation within 30 days under K.S.A. 59-1201 unless the court allows more time. Then collect assets, handle claims under K.S.A. 59-2239, pay debts and taxes, and keep records for final settlement.
  10. Close the estate by petitioning for final settlement and a final decree under K.S.A. 59-2247 and K.S.A. 59-2249. If Haskell County real estate is assigned by decree, follow the Kansas transfer-record step required for the decree.
