Which court handles jurisdiction
Probate for Cowley County is filed with the clerk of the district court under K.S.A. 20-343 in the Cowley County District Court. The district court has two Cowley County locations: the courthouse in Winfield and the second-floor court location in the Arkansas City municipal building. Both locations hear probate. The 19th Judicial District consists of Cowley County alone (K.S.A. 4-220), so there is no other county's courthouse to use.
Venue under K.S.A. 59-2203 depends on the decedent and the property. If the decedent was a Kansas resident and owned real property in the county of residence, file there. If the decedent did not own real property in the county of residence, the proceeding may be in the county of residence or in any Kansas county where the decedent owned real property. If the decedent was not a Kansas resident, the proceeding may be in any Kansas county where the decedent left estate to be administered. The first legally started proceeding controls, and a misfiled case is transferred to the proper county.
Inside Cowley County, ask the Winfield or Arkansas City clerk which location will handle a new probate filing. Each location has its own mailing address, fax number and drop box.
The jurisdiction process
- Gather the death certificate, the will if there is one, asset information, debts, names and addresses of heirs and beneficiaries, and any deed information for real estate.
- Check the Kansas will deadline before anything else. A will of a Kansas resident cannot pass property unless a petition to probate the will is filed within six months after death (K.S.A. 59-617). If you are not ready to open an estate, ask whether filing a will and affidavit under K.S.A. 59-618a can preserve the will.
- Choose the Kansas path. The small estates affidavit under K.S.A. 59-1507b can move personal property when probate assets do not exceed $75,000 effective July 1, 2023, and it is given to the holder, not filed with the court. Other paths include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified administration or supervised administration under K.S.A. 59-3202.
- Prepare the verified petition when a court case is needed. A petition for administration uses K.S.A. 59-2219, and a petition for probate of a will uses K.S.A. 59-2220. If you want simplified administration under K.S.A. 59-3202, ask for it in the petition and give reasons.
- Add the case-filing cover sheet and, if you are filing without a lawyer, the Self-Represented Litigant Certification Form. Cowley County points new filings to the statewide cover sheet under Kan. Sup. Ct. R. 123.
- File with the clerk of the district court under K.S.A. 20-343 at the Cowley County location handling the case. You may file in person in Winfield or Arkansas City, mail to PO Box 472 in Winfield or PO Box 1152 in Arkansas City, fax to 620-221-1097 or 620-442-7213, or use a drop box at either location. A drop-box filing by 4:00 p.m. local time receives same-day filing treatment under the statewide rule. Pay $131.50 as of August 2026 for probate of an estate or will, including the $109.50 statutory charge and the $22 surcharge authorized through June 30, 2030 (K.S.A. 59-104), or file a Poverty Affidavit under K.S.A. 59-104.
- The court fixes the hearing after the petition is filed (K.S.A. 59-2222). The court, not the clerk, admits the will and grants letters testamentary under K.S.A. 59-701 or letters of administration under K.S.A. 59-705.
- Give notice. Hearing notice is published once a week for three consecutive weeks, with mailing to heirs, devisees and legatees within seven days after first publication and the hearing set 10 to 30 days after the last publication (K.S.A. 59-2209). The petitioner also gives notice to creditors under K.S.A. 59-709.
- After appointment, file the inventory and valuation within 30 days after letters unless the court allows more time (K.S.A. 59-1201). Claims are governed by the later of four months from first publication or 30 days after actual notice for known or reasonably ascertainable creditors (K.S.A. 59-2239).
- Administer and close the estate. Pay allowed debts, taxes and expenses, handle any sale or transfer of property, then seek final settlement and the final decree assigning the estate (K.S.A. 59-2247, K.S.A. 59-2249).
