Before you file anything in Geary County, make a working list of the assets, debts, heirs, beneficiaries and title documents. Kansas probate choices depend heavily on whether there is real estate, whether a will must be preserved within six months (K.S.A. 59-617), and whether letters are actually needed.

Which court handles jurisdiction

Probate for Geary County is filed with the clerk of the district court at the Geary County Courthouse in Junction City, in the Geary County District Court. Geary County is part of Kansas's 8th Judicial District (K.S.A. 4-209), but Dickinson, Marion and Morris counties have their own clerks and filing counters (K.S.A. 20-343). Do not send a Geary County probate filing to Abilene, Marion or Council Grove.

Kansas venue rules are not limited to the county where the person lived. If the decedent was a Kansas resident and owned real property in the county of residence, the case belongs there. If the decedent did not own real property in the county of residence, the case may be filed in the county of residence or in any Kansas county where the decedent owned real property. If the decedent was not a Kansas resident, the case may be filed in any Kansas county where the decedent left estate to be administered. The first-filed proceeding controls, and a case filed in the wrong county is transferred rather than dismissed (K.S.A. 59-2203).

Junction City is the county seat. Fort Riley sits partly in Geary County, so some families may need to think early about out-of-state relatives, military-related records or a remote appearance request under Rule 103 (Kan. Sup. Ct. R. 103), but the probate filing still goes through the Geary County clerk of the district court (K.S.A. 20-343).

The jurisdiction process

  1. Collect the death certificate, the will if one exists, asset statements, debt information, real estate records and names and addresses for heirs and beneficiaries. If there is a Kansas will, decide within six months whether to file a petition to probate it, or at least preserve the will or a copy through filing a will and affidavit under K.S.A. 59-618a. A Kansas will cannot pass property unless the petition is filed within six months of death, unless a statutory saving rule applies (K.S.A. 59-617).
  2. Choose the Kansas route before preparing papers. A small estates affidavit under K.S.A. 59-1507b can be used for qualifying personal property when probate assets do not exceed $75,000 as of July 1, 2023, but it is presented to the property holder and does not transfer real estate. Other court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified administration or supervised administration as the court determines under K.S.A. 59-3202.
  3. Prepare the verified petition. A petition for administration or probate of a will must include the statutory information, and if you want simplified administration you must ask for it and give reasons (K.S.A. 59-2219; K.S.A. 59-2220; K.S.A. 59-3202).
  4. Add the required statewide filing papers. A new case needs a case-filing cover sheet, and a person filing without a lawyer must include the Self-Represented Litigant Certification Form. If the fee cannot be paid, add a Poverty Affidavit to ask for relief from the $131.50 probate estate filing fee as of August 2026 (K.S.A. 59-104).
  5. File with the clerk of the district court at the Geary County Courthouse, 138 E 8th Street, Junction City, KS 66441 (K.S.A. 20-343). A person filing without a lawyer may file in person, by mail to the same address, by fax to 785-762-4420 using the fax transmission sheet, or by using the courthouse drop box by 4:00 p.m. local time. Kansas-licensed attorneys must e-file under Rule 122 (Kan. Sup. Ct. R. 122).
  6. The court fixes the hearing. Kansas does not treat letters as a clerk-issued document. The court sets the hearing on a petition for probate of a will, administration or refusal to grant letters (K.S.A. 59-2222).
  7. Give notice. Notice of hearing is published once each week for three consecutive weeks, with mailing to heirs, devisees and legatees within seven days after first publication, and the hearing date falls within the statutory window after the last publication (K.S.A. 59-2209). The petitioner also gives notice to creditors within 30 days after filing the petition, as ordered by the court (K.S.A. 59-709). Do not assume the newspaper. Ask the Geary County clerk which publication the court uses.
  8. If there is a surviving spouse, send the required elective-share notice within 10 days after the relevant filing or qualification event (K.S.A. 59-2233).
  9. Attend the hearing, in person or by asking for permission to appear by phone or video under Rule 103 (Kan. Sup. Ct. R. 103). If the court grants authority, it admits the will where appropriate and grants letters testamentary to an executor named in the will or letters of administration to an administrator when there is no appointed executor (K.S.A. 59-701; K.S.A. 59-705).
  10. Administer and close the estate. File the inventory and valuation within 30 days after letters unless the court grants more time (K.S.A. 59-1201). Creditor demands are barred unless presented within the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239). Pay approved debts and taxes, then seek final settlement and a final decree assigning the estate (K.S.A. 59-2247; K.S.A. 59-2249).
