- Collect the death certificate, the will if there is one, and a first list of assets and debts. If the decedent was a Kansas resident and there is a will, decide quickly whether to petition for probate of the will or at least preserve the will, because a Kansas will cannot pass property unless a petition for probate is filed within six months after death, subject to statutory savings provisions (K.S.A. 59-617).
- Choose the right Kansas route before drafting. A small estates affidavit under K.S.A. 59-1507b is furnished to the property holder and is not a court case. Court routes may include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, filing a will and affidavit under K.S.A. 59-618a, informal administration under K.S.A. 59-3301, or simplified or supervised administration under K.S.A. 59-3202.

The judge, not the clerk, decides whether to admit the will, appoint a personal representative and grant letters testamentary under K.S.A. 59-701 or letters of administration under K.S.A. 59-705.
- Give notice as ordered. Hearing notice is published once a week for three consecutive weeks and mailed to the required people with the petition and will when applicable (K.S.A. 59-2209). The petitioner also gives notice to creditors within the Kansas creditor-notice rules (K.S.A. 59-709), and any required surviving-spouse notice must be handled under K.S.A. 59-2233.
- Ask early if someone needs to attend by phone or video. Remote appearance is discretionary under Rule 103 (Kan. Sup. Ct. R. 103), and the Kansas Judicial Council provides a free motion form. Do not assume the court will approve the request.
- After letters are granted, administer the estate. The personal representative files the inventory and valuation within 30 days after letters unless the court allows more time (K.S.A. 59-1201), gives actual notice to known or reasonably findable creditors, pays allowed debts and taxes, and watches the Kansas claims bar, which is the later of four months from first publication or 30 days after actual notice for a known or reasonably findable creditor (K.S.A. 59-2239).
- Close with a petition for final settlement and accounting and the court's final decree. The decree assigns the estate, and where real estate is involved, Kansas law includes transfer-record steps after the decree (K.S.A. 59-2247; K.S.A. 59-2249).
