Probate for Allen County is filed with the clerk of the district court at the Allen County Courthouse in Iola, Room B, under K.S.A. 20-343. Allen County is part of Kansas's 31st Judicial District with Neosho, Wilson, and Woodson counties (K.S.A. 4-232), but the Allen County case is filed at the Allen County filing counter, not at another county's courthouse.

Kansas venue depends on residence and real property. For a Kansas resident who owned real property in the county of residence, proceedings for probate of a will or administration are brought in that county. If the resident did not own real property in the county of residence, the case may be brought in the county of residence or any county where the decedent owned real property. For a nonresident, the case may be brought in any county where estate property is to be administered. A first-filed proceeding controls until venue is resolved, and a case filed in the wrong county is transferred rather than dismissed (K.S.A. 59-2203).

The jurisdiction process

  1. Find the death certificate, the will if there is one, and a first list of assets and debts. If the decedent was a Kansas resident and left a will, decide within six months of death whether to petition to probate it, or at least preserve it by filing a will and affidavit under K.S.A. 59-618a, because the will cannot pass property unless a petition is filed within six months after death unless a statutory savings rule applies (K.S.A. 59-617).
  2. Choose the Kansas route that fits the property. The small estates affidavit under K.S.A. 59-1507b can be used for qualifying personal property and is given to the holder of the property, not opened as an Allen County court case. Court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified administration or supervised administration under K.S.A. 59-3202.
  3. Prepare the petition if a court case is needed. A petition for administration or probate of a will follows the Kansas Probate Code requirements, and if you want simplified administration you must ask for it and give reasons for that request (K.S.A. 59-3202).
  4. Add the statewide case-filing cover sheet. If you are representing yourself, add the Self-Represented Litigant Certification Form. If you cannot afford the filing fee, ask about filing a Poverty Affidavit under K.S.A. 59-104.
  5. File with the clerk of the district court in Room B at 1 North Washington Avenue in Iola, by mail to that address, by fax to 620-365-1429, or through the Allen County courthouse drop box. A self-represented drop-box filing placed by 4:00 p.m. local time counts as filed that day under the Kansas Supreme Court temporary rule. The probate estate docket fee is $131.50 as of August 2026, including the $109.50 statutory amount and the $22 surcharge authorized through June 30, 2030 (K.S.A. 59-104).
  6. The court fixes the hearing after the petition is filed (K.S.A. 59-2222). If notice is required under K.S.A. 59-2209, it is published once a week for three consecutive weeks, first publication is made within 30 days after the order setting the hearing, and copies are mailed within 7 days after first publication with required attachments.
  7. Publish notice to creditors within 30 days after filing the petition when required (K.S.A. 59-709). Claims are barred unless presented within the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239).
  8. Attend the hearing in Iola unless the judge allows a phone or video appearance under Rule 103 (Kan. Sup. Ct. R. 103). At or after the hearing, the court admits the will and grants letters testamentary to an executor when appropriate (K.S.A. 59-701), or grants letters of administration to an administrator when there is no will or no executor can serve (K.S.A. 59-705).
  9. After letters are granted, file the inventory and valuation within 30 days unless the court grants more time (K.S.A. 59-1201). The personal representative then collects assets, handles creditor claims, pays allowed debts and taxes, and keeps records for final settlement.
  10. Close the estate by petitioning for final settlement and accounting. The court enters a final decree assigning the estate, and if real estate is involved the decree is used for the county transfer record as provided by Kansas law (K.S.A. 59-2247; K.S.A. 59-2249).
