- The court fixes the hearing after the petition is filed (K.S.A. 59-2222). Notice is published once each week for three consecutive weeks, and the mailing to heirs, devisees and legatees follows the timing and attachment rules in K.S.A. 59-2209. Notice to creditors is handled under K.S.A. 59-709.
- Ask for a remote appearance under Kan. Sup. Ct. Rule 103 if travel to Council Grove would be difficult. File the motion, notify the other parties and ask the clerk how the judge handles the appearance request.
- At or after the hearing, the court decides whether to admit the will, appoint the executor or administrator, grant letters testamentary under K.S.A. 59-701 or grant letters of administration under K.S.A. 59-705. The court, not the filing office, grants the authority.
- After letters are granted, file the inventory and valuation within 30 days of the letters unless the court gives more time (K.S.A. 59-1201). Creditors' demands are governed by the later of four months from first publication or 30 days after actual notice, and by the Kansas nonclaim statute (K.S.A. 59-2239).
- Pay allowed debts, expenses and taxes, then seek final settlement. The court's final decree assigns the estate, and real estate assignments are handled through the transfer record process after the decree (K.S.A. 59-2247, 59-2249).
