Which court handles jurisdiction

Scott County probate is filed with the clerk of the district court at the Scott County Courthouse in Scott City (K.S.A. 20-343). The county is in Kansas's 25th judicial district with Finney, Greeley, Hamilton, Kearny and Wichita counties (K.S.A. 4-226), but each county has its own clerk and filing counter. Kansas venue for probate of a will or administration depends on residence and real property. If the decedent lived in Scott County and owned real property in Scott County, venue is in Scott County. If the decedent lived in Scott County but owned no real property there, venue may be Scott County or a Kansas county where the decedent owned real property. If the decedent was not a Kansas resident, venue may be any Kansas county where estate property needs administration. A first-filed proceeding controls until venue is decided, and a case filed in the wrong county can be transferred (K.S.A. 59-2203).

The jurisdiction process

  1. Find the death certificate, the will if one exists, and a complete list of assets and debts. If the decedent was a Kansas resident and left a will, decide quickly whether to petition to probate it, because the will generally cannot pass property unless a petition is filed within six months after death (K.S.A. 59-617).
  2. Choose the Kansas route that fits the Scott County facts. A small estates affidavit under K.S.A. 59-1507b, with the $75,000 amount effective July 1, 2023, is presented to the holder of personal property and is not a Scott County court filing. Other court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, filing a will and affidavit under K.S.A. 59-618a, informal administration under K.S.A. 59-3301, and simplified administration or supervised administration under K.S.A. 59-3202.
  3. Prepare the petition for the Scott County District Court. If you want simplified administration, ask for it in the petition and give reasons, because the court decides at the hearing whether the estate will proceed as a simplified estate or a supervised estate (K.S.A. 59-3202).
  4. Add the required new-case paperwork. A new case needs a case-filing cover sheet, and a person filing without a lawyer also files the Self-Represented Litigant Certification Form. If the filing fee cannot be paid, ask the clerk about filing the Poverty Affidavit under K.S.A. 59-104.
  5. File with the clerk of the district court at 303 Court St in Scott City (K.S.A. 20-343). A self-represented filer may file in person, by mail, by fax to 620-872-3683 or in the drop box. A drop-box filing placed by 4:00 p.m. local time counts that day. As of August 2026, the probate estate filing fee is $131.50 under K.S.A. 59-104.
  6. The court fixes the hearing after the petition is filed. Notice is published once a week for three consecutive weeks, and mailed notice to heirs, devisees and legatees follows the timing and attachment rules in K.S.A. 59-2209. Notice to creditors is published within the statutory period after filing under K.S.A. 59-709.
  7. Ask early if a remote appearance is needed. Rule 103 lets the judge allow a remote appearance, including where travel time or expense outweighs the benefit of appearing in person, but permission is discretionary. File the Judicial Council motion form and notify the other parties.
  8. At or after the hearing, the court can admit the will, grant letters testamentary to an executor (K.S.A. 59-701) or grant letters of administration to an administrator (K.S.A. 59-705). The personal representative then gathers assets, gives required notices and follows the court's orders.
  9. File the inventory and valuation within 30 days after the letters unless the court gives more time (K.S.A. 59-1201). Creditors are barred unless they present demands within the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239).
  10. Pay allowed debts, expenses and taxes, then request final settlement. The court's final decree assigns the estate, and real estate assignments are handled through the Kansas transfer-record process described in K.S.A. 59-2249.
