The jurisdiction process

  1. Gather the death certificate, the will if one exists, the asset list, known debts, beneficiary names, and addresses. If there is a Kansas will, decide quickly whether to petition for probate of the will or at least preserve it, because a will of a Kansas resident cannot pass property unless a petition is filed within six months after death, unless a savings provision applies (K.S.A. 59-617).
  2. Choose the Kansas path before preparing papers. Common choices include the small estates affidavit under K.S.A. 59-1507b for qualifying personal property handled with the holder rather than through a court case, filing a will and affidavit under K.S.A. 59-618a to preserve a will, refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
  3. Prepare the petition if a Rawlins County court case is needed. A petition for administration follows K.S.A. 59-2219, and a petition for probate of a will follows K.S.A. 59-2220. If you want simplified administration, ask for it in the petition and give reasons, because the court decides under K.S.A. 59-3202.
  4. Add the required filing documents. A new Kansas case needs a case-filing cover sheet, and a self-represented filer must also file the Self-Represented Litigant Certification Form.   7. Give notice as the court orders. Hearing notice is published once each week for three consecutive weeks, mailed within 7 days after first publication to known heirs, devisees, and legatees, and the hearing date must follow the timing in K.S.A. 59-2209. The petitioner also gives notice to creditors within 30 days after filing as ordered by the court (K.S.A. 59-709). If there is a surviving spouse, the statutory elective-share notice must be mailed within 10 days when K.S.A. 59-2233 applies.
  8. Attend the hearing. The court, not the clerk, decides whether to admit the will and grant letters testamentary to an executor (K.S.A. 59-701), or grant letters of administration to an administrator when there is no will or no executor able to serve (K.S.A. 59-705).
  9. Administer the estate after letters are granted. File the inventory and valuation within 30 days after letters unless the court allows more time (K.S.A. 59-1201). Give actual notice to known or reasonably ascertainable creditors, pay allowed debts and taxes, and track claims under the later of four months from first publication or 30 days after actual notice under K.S.A. 59-2239.
  10. Close by petitioning for final settlement and asking for the final decree assigning the estate (K.S.A. 59-2247; K.S.A. 59-2249). If the decree assigns real estate, follow the Kansas transfer-record step required by K.S.A. 59-2249.
