Which court handles jurisdiction

Probate for Shawnee County is filed with the clerk of the district court at the Shawnee County Courthouse, 200 SE 7th St., Room 209, Topeka, Kansas. Shawnee County is the entire 3rd Judicial District (K.S.A. 4-204), so every Shawnee County probate filing goes to this courthouse rather than to another county.

Venue is governed by K.S.A. 59-2203. If the decedent lived in Kansas and owned real property in the county of residence, probate of a will or administration is filed in that county. If the decedent owned no real property in the county of residence, the filing may be in the county of residence or in any Kansas county where the decedent owned real property. If the decedent was not a Kansas resident, the filing may be in any Kansas county where the decedent left estate to be administered. The first legally filed proceeding controls, and if venue belongs in another county, the district court transmits the file there.

The jurisdiction process

  1. Gather the death certificate, the original will if there is one, and a working list of assets, debts and taxes. Shawnee County's local rule makes the inventory and valuation due within 30 days after letters (K.S.A. 59-1201), even if some asset information is still incomplete.
  2. Watch the Kansas will deadline before anything else. A will of a Kansas resident cannot pass property unless a petition for probate of the will is filed within six months after death (K.S.A. 59-617). If the family is not ready to open a full estate, filing a will and affidavit under K.S.A. 59-618a may preserve the will for later probate.
  3. Choose the right statewide path. That may be the small estates affidavit under K.S.A. 59-1507b, which is given to the bank or other holder and is not filed with the court; refusal to grant letters under K.S.A. 59-2287; determination of descent under K.S.A. 59-2250; informal administration under K.S.A. 59-3301; or simplified or supervised administration, which the court decides under K.S.A. 59-3202.
  4. Prepare the petition. For administration, use the statutory requirements in K.S.A. 59-2219. For probate of a will, use K.S.A. 59-2220. Shawnee County's local rule requires a written, signed and verified petition with the petitioner's name, residence and address, the petitioner's interest and right to apply, jurisdiction facts, numbered factual and legal allegations, and a complete statement of the relief requested.
  5. Add the required filing papers. Shawnee County's rule requires a completed cover sheet with every new filing. A person filing without a lawyer also files the Self-Represented Litigant Certification Form. Leave two inches of blank space in the upper right corner for the file stamp and number every page, including attachments.
  6. File with the clerk of the district court in Room 209 (K.S.A. 20-343). As of August 2026, the amount to open a probate estate is $131.50, made up of the $109.50 statutory amount plus the $22 surcharge (K.S.A. 59-104), unless you file a Poverty Affidavit under K.S.A. 59-104. A person filing without a lawyer may file in person, by mail, by fax to 785-251-4908, or in the courthouse drop box by 4:00 p.m. local time. Attorneys file electronically under Kansas Supreme Court Rule 122.
  7. Get the hearing date. Shawnee County's probate rule makes it the duty of the filing attorney or petitioner without a lawyer to obtain a hearing date and provide an Order for Hearing for signature. Filing the petition alone does not place the matter on a calendar. The court fixes the hearing under K.S.A. 59-2222.
  8. Publish and mail notice. Hearing notice is published once each week for three consecutive weeks (K.S.A. 59-2209). Within seven days after first publication, mail the notice to each known heir, devisee and legatee, with the petition, attachments and will when applicable. Notice to creditors is published within 30 days after filing the petition (K.S.A. 59-709).
  9. Give the additional notices. Written elective share notice goes to a surviving spouse within 10 days under K.S.A. 59-2233. Shawnee County also requires notice to the appropriate state medical assistance agency if the decedent or a predeceased spouse received state medical assistance, and the final settlement petition must address that point.
  10. Attend the hearing. The hearing is set not earlier than 10 days and not later than 30 days after the last publication (K.S.A. 59-2209). A phone or video appearance is discretionary under Kansas Supreme Court Rule 103, and the Kansas Judicial Council publishes a motion form for that request.
  11. After the hearing, the judge admits the will and grants letters testamentary to an executor under K.S.A. 59-701 or letters of administration to an administrator under K.S.A. 59-705. The court, not the clerk, grants the authority to act.
  12. Administer the estate. File the inventory and valuation within 30 days of letters (K.S.A. 59-1201), handle claims within the later of four months from first publication or 30 days after actual notice to a known creditor (K.S.A. 59-2239), pay debts and taxes, and keep copies of anything filed because most paper is scanned and later destroyed, while original wills are kept until the court orders otherwise.
  13. Close with a petition for final settlement and a final decree assigning the estate (K.S.A. 59-2247, 59-2249). If more time is needed before final settlement, Shawnee County requires the verified accounting to be filed with the extension request and notice to interested parties.

Executor duties

Shawnee County adds several practical duties to the statewide role of a personal representative. The inventory and valuation must be filed within 30 days after letters (K.S.A. 59-1201), even if some asset information is not yet available, and a newly discovered asset must be supplemented within 30 days with the paperwork this court requires.

The filing party must obtain the hearing date and present an Order for Hearing, and must know the statutory notice periods and time limits. The court's local rule says staff will not advise on those requirements. If the surviving spouse is also the executor, administrator or petitioner, Shawnee County allows the spouse to acknowledge awareness of elective share rights by pleading or affidavit under K.S.A. 59-2233.

If the decedent or a predeceased spouse received state medical assistance, the appropriate state agency must receive notice, and the final settlement petition must say either that no such assistance was paid or that the paying state was notified. If more time is needed before final settlement, file the verified accounting with the extension request.
