Which court handles jurisdiction
File Gove County probate matters with the clerk of the district court for Gove County at the courthouse in Gove (K.S.A. 20-343). Gove County is one of the counties in Kansas's 23rd Judicial District (K.S.A. 4-224), but the district number does not move the filing to another county.
Kansas venue depends on residence and real property. If the decedent was a Kansas resident and owned real property in the county of residence, file in that county. If the resident decedent did not own real property in the county of residence, venue can be the county of residence or a Kansas county where the decedent owned real property. For a nonresident decedent, venue can be any Kansas county where estate property is to be administered. The first legally commenced case controls, and a case filed in the wrong Kansas county is transferred to the proper county (K.S.A. 59-2203).
The jurisdiction process
- Collect the death certificate, the will if one exists, account information, debt information and real estate information. If the person died a Kansas resident, decide quickly whether a petition to probate the will must be filed in Gove County, because the will cannot pass property unless the petition is filed within six months after death unless a statutory savings rule applies (K.S.A. 59-617).
- If the family is not ready to open a full estate but needs to protect the will, ask whether filing a will and affidavit in the district court of the decedent's last residence is enough for now. Kansas allows the will or a copy to be filed with that affidavit to preserve later probate if it is filed within six months after death (K.S.A. 59-618a; K.S.A. 59-617).
- Choose the filing path. Kansas options include the small estates affidavit for qualifying personal property, effective July 1, 2023 for probate assets not exceeding $75,000 (K.S.A. 59-1507b), refusal to grant letters (K.S.A. 59-2287), determination of descent after the statutory conditions are met (K.S.A. 59-2250), informal administration (K.S.A. 59-3301), and simplified or supervised administration as the court determines (K.S.A. 59-3202).
- Prepare the petition if a court case is needed. A petition for administration or probate of a will must include the information Kansas law requires, and if you want simplified administration you must ask for it and give reasons (K.S.A. 59-2219; K.S.A. 59-2220; K.S.A. 59-3202).
- Add the case-filing cover sheet. If you are representing yourself, also add the Self-Represented Litigant Certification Form. If you cannot pay the filing charge, ask about the Poverty Affidavit tied to probate fees (K.S.A. 59-104).
- File with the Gove County clerk in person, by mail to PO Box 97, by fax to 785-938-2312 or by drop box. The probate estate filing is $131.50, current on and after July 1, 2026 through June 30, 2030, made up of the $109.50 statutory amount plus the $22 surcharge (K.S.A. 59-104).
- After the petition is filed, the court fixes the hearing (K.S.A. 59-2222). Hearing notice is published once a week for three consecutive weeks, and the first publication must be within 30 days after the order fixing the hearing (K.S.A. 59-2209). The petitioner also mails the notice, petition, attachments and will where required within 7 days after the first publication (K.S.A. 59-2209).
- Handle creditor and spouse notices. The petitioner gives notice to creditors within 30 days after filing the petition (K.S.A. 59-709). Known or reasonably ascertainable creditors receive actual notice before the nonclaim deadline, and claims are barred unless presented within the later of four months from first publication or 30 days after actual notice (K.S.A. 59-2239). If there is a surviving spouse, the required elective-share notice must be mailed within 10 days when K.S.A. 59-2233 applies.
- Attend the hearing or ask in advance to appear by phone or video. Remote appearance is discretionary under Rule 103, and the Kansas Judicial Council publishes a motion form for that request. If the court admits the will and appoints a fiduciary, the court grants letters testamentary to an executor (K.S.A. 59-701) or letters of administration to an administrator (K.S.A. 59-705).
- Administer and close the estate. The personal representative files the inventory and valuation within 30 days after letters unless the court allows more time (K.S.A. 59-1201), pays valid debts and taxes, completes any sale or transfer steps the court requires, and asks for final settlement. The court's final decree assigns the estate, and real estate decrees are handled with the county clerk's transfer record as Kansas law requires (K.S.A. 59-2247; K.S.A. 59-2249).
