Which court handles jurisdiction

Norton County probate is filed with the clerk of the district court under K.S.A. 20-343 at the Norton County Courthouse in Norton. Norton County is part of Kansas's 17th Judicial District under K.S.A. 4-218, along with Decatur, Graham, Osborne, Phillips and Smith counties, but the filing counter for a Norton County case remains in Norton.

Venue is governed by K.S.A. 59-2203. If the decedent was a Kansas resident and owned real property in the county of residence, probate belongs in that county. If the decedent was a Kansas resident but owned no real property in the county of residence, the case may be filed in the county of residence or in a county where the decedent owned real property. If the decedent was not a Kansas resident, the case may be filed in a Kansas county where the decedent left estate to be administered. If proceedings start in more than one county, the first-filed case controls while venue is sorted out, and a case filed in the wrong county can be transferred.

The jurisdiction process

  1. Gather the death certificate, the will if there is one, a list of heirs and beneficiaries, real estate descriptions, account statements and debts. If there is a will, decide quickly whether to petition for probate because a will generally must be petitioned within six months after death under K.S.A. 59-617.
  2. If the family is not ready for a full estate case, ask whether filing a will and affidavit under K.S.A. 59-618a will preserve the will. The fee chart also lists $70.50 as of August 2026 for filing a will and affidavit under K.S.A. 59-104, and it separately lists filing a will after the testator's death as no fee, so call the Norton County clerk about the filing category before submitting it.
  3. Choose the right Kansas path. The small estates affidavit under K.S.A. 59-1507b, effective July 1, 2023 for estates at or below $75,000, is furnished to the holder of personal property. Court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified administration or supervised administration under K.S.A. 59-3202.
  4. Prepare the petition. A petition for administration follows K.S.A. 59-2219, and a petition to probate a will follows K.S.A. 59-2220. If you want simplified administration, ask for it in the petition and give the reasons because the court decides under K.S.A. 59-3202.
  5. Add the case filing cover sheet and, if you are filing without a lawyer, the Self-Represented Litigant Certification Form. If you cannot pay, add the Poverty Affidavit request tied to K.S.A. 59-104.
  6. File with the Norton County clerk of the district court under K.S.A. 20-343. A self-represented filer may file in person, by mail to PO Box 70, Norton, KS 67654, by fax to 785-877-5722, or by the drop box; a drop-box filing made by 4:00 p.m. local time counts that day. Pay the $131.50 probate estate filing cost as of August 2026 under K.S.A. 59-104 unless the court grants a fee waiver.
  7. The court fixes the hearing under K.S.A. 59-2222. Hearing notice is published once a week for three consecutive weeks under K.S.A. 59-2209, with mailing to known heirs, devisees and legatees within seven days after the first publication. Notice to creditors is published within 30 days after filing under K.S.A. 59-709.
  8. If there is a surviving spouse, make sure the statutory elective-share notice is handled within 10 days when K.S.A. 59-2233 applies.
  9. Attend the hearing in Norton County unless the court allows a phone or video appearance under Kan. Sup. Ct. Rule 103. The court, not the clerk, admits the will if appropriate and grants letters testamentary under K.S.A. 59-701 or letters of administration under K.S.A. 59-705.
  10. After letters are granted, file the inventory and valuation within 30 days under K.S.A. 59-1201 unless the court allows more time. Administer the estate, handle claims under the later-of rule in K.S.A. 59-2239, pay debts and taxes, and then seek final settlement and the final decree under K.S.A. 59-2247 and K.S.A. 59-2249.
