Finney County probate is handled by the Finney County District Court at the Finney County Courthouse in Garden City. The filing office is the Finney County clerk of the district court (K.S.A. 20-343). Finney County is part of Kansas's 25th Judicial District with Scott, Wichita, Greeley, Hamilton and Kearny counties (K.S.A. 4-226), but a Finney County case is filed in Garden City.
Kansas venue turns on residence and real property. If the decedent was a Kansas resident and owned real property in the county of residence, probate or administration belongs in that county. If the resident did not own real property in the county of residence, the case may be filed in the county of residence or in a county where the decedent owned real property. For a nonresident, the case may be filed in any Kansas county where estate property is to be administered. If proceedings start in more than one county, the first filed proceeding controls until venue is decided, and a case filed in the wrong county is transferred to the proper county (K.S.A. 59-2203).
The jurisdiction process
- Gather the death certificate, the will if there is one, known debts, beneficiary information and an asset list. If the decedent was a Kansas resident with a will, decide promptly whether to file a petition for probate of the will in Finney County. Kansas gives the will six months after death to be petitioned for probate, unless a statutory savings step applies (K.S.A. 59-617).
- If the family is not ready to open an estate but wants to preserve the will, ask whether filing a will and affidavit under K.S.A. 59-618a is the right step. Court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent after the required time has run under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
- Prepare the petition using the statutory requirements for administration or probate of a will. If you want simplified administration, ask for it in the petition and give reasons for it (K.S.A. 59-3202). A new case also needs the Kansas case filing cover sheet, and a self-represented filer needs the Self-Represented Litigant Certification Form.
- File with the Finney County clerk of the district court at 425 N 8th St in Garden City, by mail to that address, by fax to 620-271-6140 or in the courthouse drop box (K.S.A. 20-343). A self-represented drop box filing placed by 4:00 p.m. local time counts as filed that day. - The court fixes the hearing after the petition is filed (K.S.A. 59-2222). Notice is published once each week for three consecutive weeks, and mailed to heirs, devisees and legatees with the petition and will when required (K.S.A. 59-2209). Notice to creditors is published under the court's order within 30 days after the petition is filed (K.S.A. 59-709).
- If the decedent left a surviving spouse, make sure the required elective share notice is handled within 10 days when that duty applies (K.S.A. 59-2233). The hearing date must follow the Kansas notice timing, and any request to appear by phone or video should be made by motion under Kansas Supreme Court Rule 103 (Kan. Sup. Ct. R. 103).
- At or after the hearing, the court admits the will and grants letters testamentary to a qualified executor when there is a will (K.S.A. 59-701), or grants letters of administration to a qualified administrator when there is no will (K.S.A. 59-705). The clerk files papers and collects fees, while the court grants the authority.
- After letters are granted, the personal representative files the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Claims are governed by the Kansas nonclaim rule, including the later of four months from first publication or 30 days after actual notice for a known or reasonably ascertainable creditor (K.S.A. 59-2239).
- Pay allowed debts, taxes and expenses, then seek final settlement. The court reviews the petition for final settlement and accounting and enters the final decree assigning the estate (K.S.A. 59-2247; K.S.A. 59-2249).
