Before you begin — know the assets and liabilities
Before choosing a Decatur County filing, make a working list of the assets, debts, beneficiary designations, real estate, and whether anyone has the original will or only a copy. Kansas treats the will deadline separately from the value of the estate, so an estate that looks simple can still need prompt action if a will may matter (K.S.A. 59-617).
Sunset helps families begin estate settlement by searching across more than 2,300 financial institutions for accounts and assets, then organizing what was found into a probate packet or attorney handoff for Decatur County.
Which court handles jurisdiction
File Decatur County probate matters with the clerk of the district court at the Decatur County Courthouse in Oberlin. The court sits in Kansas's 17th Judicial District (K.S.A. 4-218), but the filing counter for a Decatur County estate is Decatur County's own clerk of the district court (K.S.A. 20-343).
Kansas venue depends on residence and real property. If the decedent lived in Kansas and owned real property in the county of residence, venue is that county. If the decedent did not own real property in the county of residence, venue may be the county of residence or any county where the decedent owned real property. If the decedent was not a Kansas resident, venue may be any Kansas county where estate property is to be administered. A first-filed case controls while venue is decided, and a case filed in the wrong county is transferred to the proper county (K.S.A. 59-2203).
The jurisdiction process
- Collect the death certificate, the will if one exists, a list of heirs and devisees, asset information, debts, and real estate details. If the decedent was a Kansas resident with a will, decide within six months whether to file a petition to probate the will or at least preserve the will by filing a will and affidavit under K.S.A. 59-618a, because the will cannot pass property unless a petition is filed within six months after death unless a savings provision applies (K.S.A. 59-617).
- Choose the Kansas route before drafting. A small estates affidavit under K.S.A. 59-1507b is presented to the bank or other holder for personal property and is not a court filing. Court routes include refusal to grant letters of administration (K.S.A. 59-2287), determination of descent after the statutory waiting point (K.S.A. 59-2250), informal administration (K.S.A. 59-3301), and simplified administration or supervised administration as the court decides under K.S.A. 59-3202.
- Prepare the petition for the route you chose. If you want simplified administration, ask for it in the petition and give reasons, because the court decides whether the estate proceeds as simplified or supervised administration (K.S.A. 59-3202).
- Add a Kansas case-filing cover sheet. If you are filing without a lawyer, also add the Self-Represented Litigant Certification Form. If you cannot afford the $131.50 docket fee current for filings on and after July 1, 2026, through June 30, 2030, you may file a Poverty Affidavit under K.S.A. 59-104.
- File with the Decatur County clerk of the district court at 120 E Hall St., 3rd Floor, Oberlin, or mail the papers to PO Box 89, Oberlin, KS 67749. A self-represented filer may also fax the filing to 785-475-8170 or use the courthouse drop box at the east door. Kansas-licensed attorneys must use approved e-filing under Rule 122.
- Pay the $131.50 docket fee current for filings on and after July 1, 2026, through June 30, 2030, for a probate estate, unless the court grants a fee waiver. That amount is the $109.50 statutory charge plus the $22 surcharge (K.S.A. 59-104). Keep separate funds available for publication, service, attorney fees, personal representative fees, and other court costs the court taxes to the estate (K.S.A. 59-104(d)).
- After the petition is filed, the court fixes the hearing for probate, administration, or refusal to grant letters of administration (K.S.A. 59-2222). If a remote appearance would reduce travel or expense, file the Kansas Judicial Council motion and notify the other parties. The judge has discretion under Rule 103.
- Give notice as ordered. Hearing notice that uses K.S.A. 59-2209 is published once a week for three consecutive weeks, with the first publication within 30 days after the order, and mailed within 7 days after the first publication to known heirs, devisees, and legatees with the petition and will attached unless the court excuses an attachment. Notice to creditors is published within 30 days after filing the petition (K.S.A. 59-709).
- Attend the hearing. If the court admits the will and appoints the named executor, the court grants letters testamentary (K.S.A. 59-701). If there is no will or no executor can serve, the court grants letters of administration as Kansas law provides (K.S.A. 59-705).
- After letters are granted, file the inventory and valuation within 30 days unless the court gives more time (K.S.A. 59-1201). Give actual notice to known or reasonably ascertainable creditors. Claims are governed by the later of four months from first publication or 30 days after actual notice, with the separate Kansas nonclaim rules in K.S.A. 59-2239.
- Administer the estate, pay allowed debts and taxes, handle any sale or transfer that requires court authority, and prepare the petition for final settlement. The court settles the account and enters the final decree assigning the estate, and real estate assignments are handled through the county clerk's transfer record as Kansas law provides (K.S.A. 59-2247; K.S.A. 59-2249).

Scenarios
| Situation | Likely Decatur County path | Where Sunset helps |
|---|---|---|
| Surviving spouse w/ co-owned home | Start by identifying how the Oberlin or Decatur County real estate is titled. A co-owned home may need a termination of joint tenancy filing, and the spouse may also need advice about the homestead allowance under K.S.A. 59-6a215, family allowance under K.S.A. 59-403, and the elective-share notice required by K.S.A. 59-2233. | Sunset organizes accounts, deeds, loans, and beneficiary information so the spouse and any attorney can decide what court filing is actually needed. |
| Out-of-state adult child w/ small estate | If the estate has no real estate and the probate assets are $75,000 or less under K.S.A. 59-1507b, the Small Estates Affidavit may clear personal property without a Decatur County case. If letters are needed, an out-of-state personal representative can serve after appointing a Kansas resident agent in writing and filing the agent's written acceptance (K.S.A. 59-706; K.S.A. 59-1706). A Rule 103 motion may reduce travel for hearings. | Sunset finds accounts, prepares an organized asset list, and helps the family decide whether to use an affidavit, file in Decatur County, or speak with a Kansas attorney. |
| Parent settling predeceased child's estate, home must be sold | The Small Estates Affidavit under K.S.A. 59-1507b does not transfer real estate. A Decatur County home sale may require refusal to grant letters of administration under K.S.A. 59-2287, informal administration under K.S.A. 59-3301, or simplified administration if the court allows it under K.S.A. 59-3202. If there is a will, preserve the six-month filing issue under K.S.A. 59-617. | Sunset builds the estate settlement inventory, flags the real estate issue, and can connect the parent with a Kansas probate attorney for the sale and court order. |

When to hire an attorney
Consider legal counsel if the will deadline is close, heirs disagree, the estate includes real estate, a Decatur County home must be sold, a creditor issue appears, a nonresident personal representative needs a Kansas resident agent under K.S.A. 59-1706, or you are unsure whether refusal to grant letters of administration, informal administration, simplified administration, or supervised administration fits. Kansas allows fiduciary and attorney compensation that is just and reasonable, as the court allows under K.S.A. 59-1717. Sunset connects to a vetted attorney.

Possibly. A Kansas district court has discretion to allow a remote appearance under Rule 103.
