Venue under K.S.A. 59-2203 depends on residence and real property. If the decedent was a Kansas resident and owned real property in the county of residence, file there. If the resident decedent owned no real property in the county of residence, the proceeding may be filed in the county of residence or in a Kansas county where the decedent owned real property. For a nonresident, file in a Kansas county where estate property needs administration. If competing proceedings are started in more than one county, the first-filed case controls until venue is determined, and a case filed in the wrong Kansas county is transferred.

The jurisdiction process

  1. Find the will, death certificate and asset list. If the decedent was a Kansas resident and there is a will, decide within six months after death whether to petition for probate of the will, or at least preserve the will by filing a will and affidavit under K.S.A. 59-618a, because a will cannot pass property unless the petition is filed within six months (K.S.A. 59-617).
  2. Choose the Kansas route before drafting. A small estates affidavit under K.S.A. 59-1507b is used with the property holder for qualifying personal property and is not opened as a court case. Court routes may include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration as the court determines under K.S.A. 59-3202.
  3. Prepare the petition if a Jefferson County case is needed. A petition for administration or probate of a will is drafted from K.S.A. 59-2219 or K.S.A. 59-2220. If you want simplified administration, ask for it in the petition and give reasons for that request (K.S.A. 59-3202).
  4. Add the required statewide filing documents. A new case needs a case-filing cover sheet, and a person filing without a lawyer must add the Self-Represented Litigant Certification Form. If you cannot afford the $131.50 docket fee as of August 2026, made up of the $109.50 statutory fee and $22 surcharge, ask the court about filing a Poverty Affidavit under K.S.A. 59-104.
  5. File with the Jefferson County clerk of the district court (K.S.A. 20-343). File in person at 300 Jefferson Street in Oskaloosa, by mail to P.O. Box 327, Oskaloosa, KS 66066, by fax to 785-863-2369, or in the courthouse drop box by 4:00 p.m. local time. Attorneys use e-filing under Rule 122 (Kan. Sup. Ct. R. 122).
  6. The court fixes the hearing. When a petition for probate of a will, administration, or refusal to grant letters is filed, the court sets the time and place for hearing (K.S.A. 59-2222). Ask early if you need to appear by phone or video under Rule 103 (Kan. Sup. Ct. R. 103).
  7. Complete notice. Hearing notice is published once each week for three consecutive weeks, with mailing to heirs, devisees and legatees within 7 days after first publication and the hearing set 10 to 30 days after the last publication (K.S.A. 59-2209). Notice to creditors is also required within 30 days after filing the petition (K.S.A. 59-709).
  8. Attend the hearing. The judge, not the clerk, admits the will if appropriate and grants letters testamentary to an executor under K.S.A. 59-701 or letters of administration to an administrator under K.S.A. 59-705.
  9. Administer the estate. File the inventory and valuation within 30 days after letters are granted unless the court allows more time (K.S.A. 59-1201). Creditor demands are barred unless presented within the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239). Pay debts, taxes and court-approved costs as required.
  10. Close the case. When administration is ready to finish, file the petition for final settlement and accounting, then obtain the court's final decree assigning the estate (K.S.A. 59-2247; K.S.A. 59-2249). Estate settlement is complete only after the court approves the final account and the required transfers are made.
