The jurisdiction process
- Find the death certificate, the will if one exists, account information, deeds and debts. Check the six-month will deadline at the start: a Kansas will of a Kansas resident must be petitioned for probate within the six-month period set by K.S.A. 59-617, unless a savings provision applies.
- If the family is not ready for a full estate case, consider whether filing a will and affidavit under K.S.A. 59-618a, including a copy of the will if needed, should be used to preserve the will within the K.S.A. 59-617 deadline.
- Choose the filing route. A small estates affidavit under K.S.A. 59-1507b can be furnished to a bank or other holder for qualifying personal property. A refusal to grant letters proceeding under K.S.A. 59-2287, a determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration under K.S.A. 59-3202 may fit other estates, especially where real estate or letters are needed.
- Prepare the petition. If you want simplified administration, ask for it in the petition and give the reasons required by Kansas law (K.S.A. 59-3202). Add the case-filing cover sheet. If you are filing without a lawyer, add the Self-Represented Litigant Certification Form.
- File with the Republic County clerk of the district court in Belleville (K.S.A. 20-343). - Mail the surviving spouse the statutory elective-share notice when Kansas law requires it (K.S.A. 59-2233). This is separate from the public notice and creditor process.
- At or after the hearing, the court decides whether to admit the will, appoint the personal representative and grant letters testamentary to an executor (K.S.A. 59-701) or letters of administration to an administrator (K.S.A. 59-705). The court, not the filing counter, makes that decision.
- After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201), collect assets, handle claims, pay debts and taxes, then request final settlement and the final decree assigning the estate (K.S.A. 59-2247, K.S.A. 59-2249).
