Venue in Kansas depends on residence and real property. If the decedent lived in Kansas and owned real property in the county of residence, file there. If the decedent lived in Kansas but did not own real property in the county of residence, the case may be filed in the county of residence or in a county where the decedent owned real property. The jurisdiction process

  1. Gather the death certificate, the will or copy if one exists, asset information, debts and contact information for heirs, devisees and legatees. If the decedent was a Kansas resident, decide within six months after death whether to petition to probate the will, or at least preserve it by filing a will and affidavit under K.S.A. 59-618a, because K.S.A. 59-617 controls whether the will can pass property.
  2. Choose the Kansas route that fits the assets. A small estates affidavit under K.S.A. 59-1507b is used with the holder of personal property, not as a court filing. Court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250 after the statutory timing is met, informal administration under K.S.A. 59-3301 and administration that may be simplified or supervised under K.S.A. 59-3202.
  3. Prepare the verified petition using the Kansas Probate Code requirements. If you want simplified administration, ask for it and give the reasons in the petition because the court decides under K.S.A. 59-3202.
  4. Add the case-filing cover sheet. If you are filing without a lawyer, also add the Self-Represented Litigant Certification Form. Both are statewide Kansas Judicial Council forms.
  5. File with the Harvey County clerk of the district court (K.S.A. 20-343) at the second floor of the Harvey County Courthouse, by mail to PO Box 687, Newton, KS 67114, by fax to 316-283-4601, or by drop box where available. A drop-box filing made by 4 p.m. local time counts that day under the statewide self-represented filing rule. Pay $131.50 as of August 2026, or submit a Poverty Affidavit if you are asking for a waiver (K.S.A. 59-104).
  6. The court fixes the hearing. For hearing notice, publication is once each week for three consecutive weeks, the mailing to known heirs, devisees and legatees follows the statutory timing, and the hearing date must fit the Kansas publication window (K.S.A. 59-2209). The petitioner also gives notice to creditors within the Kansas timetable (K.S.A. 59-709).
  7. If there is a surviving spouse, send the elective-share notice required by Kansas law within 10 days of the filing or qualification event that triggers it (K.S.A. 59-2233).
  8. Attend the hearing in Newton unless the judge allows a phone or video appearance under Kan. Sup. Ct. R. 103. The court, not the clerk, admits the will, appoints the executor or administrator and grants letters testamentary under K.S.A. 59-701 or letters of administration under K.S.A. 59-705.
  9. After letters are granted, file the inventory and valuation within 30 days unless the court gives more time (K.S.A. 59-1201). Publish and mail creditor notices as required. Claims are barred under the later-of rule for four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239).
  10. Collect assets, pay approved debts, taxes and expenses, then close through a petition for final settlement and the court's final decree assigning the estate. If the decree affects Harvey County real estate, follow the Kansas transfer-record step with the county clerk after the court enters the decree (K.S.A. 59-2247, 59-2249).
