Before you begin — know the assets and liabilities

Before you choose a filing, make a simple inventory of what the person owned, what passed outside probate, what debts are known, whether there is real estate, and whether there is a will. Kansas's six-month will rule can make timing the first estate settlement decision, not the last one (K.S.A. 59-617).

Saline County filings go to the clerk of the district court in Salina under K.S.A. 20-343. Sunset can help you find accounts and assets across more than 2,300 institutions before you prepare the petition, so the local filing fits the estate instead of guessing from memory.

Which court handles jurisdiction

Probate for Saline County is filed with the clerk of the district court at the Saline County Courthouse in Salina under K.S.A. 20-343. Saline County sits in Kansas's 28th judicial district with Ottawa County under K.S.A. 4-229, but the district number is not a filing address. Saline County cases are filed in Salina.

Kansas venue for probate or administration is governed by K.S.A. 59-2203. If the decedent lived in Kansas and owned real property in the county of residence, the case belongs in that county. If the decedent lived in Kansas but did not own real property in the county of residence, the case may be filed in the county of residence or in any Kansas county where the decedent owned real property. If the decedent was not a Kansas resident, the case may be filed in any Kansas county where the decedent left estate to be administered. If more than one county is started, the first legally commenced case controls unless the court transfers the file to the proper county.

The jurisdiction process

  1. Find the will, death certificate, asset list, debt list, and real estate information. If there is a will, decide before the six-month date whether to petition for probate of the will or preserve it by filing a will and affidavit under K.S.A. 59-618a, because a Kansas will generally cannot pass property unless the probate petition is filed within six months after death (K.S.A. 59-617).
  2. Choose the Kansas path that fits the estate. The small estates affidavit under K.S.A. 59-1507b is used with the holder of personal property, not filed as a court case. Court options can include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250 after the required time has passed, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration under K.S.A. 59-3202.
  3. Prepare the petition for the Saline County District Court. If you want simplified administration, ask for it in the petition and give the reasons required by Kansas law (K.S.A. 59-3202).
  4. Add the required new-case cover sheet and, if you are filing without a lawyer, the Self-Represented Litigant Certification Form. If you cannot afford the filing fee for an August 2026 probate estate, you may ask about a Poverty Affidavit under K.S.A. 59-104.
  5. File with the clerk of the district court in Saline County under K.S.A. 20-343. You may file in person at 300 W. Ash, 3rd floor, Room 306 in Salina, by mail to P.O. Box 1760, Salina, KS 67402, by fax to 785-309-5845, or in the courthouse drop box by 4:00 p.m. local time. The probate phone line is 785-309-5834 or 785-309-5832.
  6. Pay the August 2026 probate estate filing fee of $131.50 under K.S.A. 59-104, unless the court allows a fee waiver. Attorneys must use e-filing under Rule 122.
  7. After the petition is filed, the court fixes the hearing under K.S.A. 59-2222. Required hearing notice is published once a week for three consecutive weeks, with mailing to required people within the statutory window (K.S.A. 59-2209). Notice to creditors is also handled under K.S.A. 59-709.
  8. Ask early if you need to appear by phone or video. Remote appearance is discretionary under Rule 103, and the Kansas Judicial Council publishes a Motion to Appear in Court by Phone or Video.
  9. At or after the hearing, the court admits the will if appropriate and grants letters testamentary to an executor under K.S.A. 59-701 or letters of administration to an administrator under K.S.A. 59-705.
  10. After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201), publish and mail the required notices, handle creditor demands under the nonclaim statute in K.S.A. 59-2239, pay debts and taxes, and then seek final settlement and the court's final decree.

Scenarios

SituationLikely Saline County pathWhere Sunset helps
Surviving spouse with a co-owned homeStart by checking how the Salina-area home is titled. A co-owned home may need a title-clearing filing rather than full administration, and a surviving spouse may also need information about the homestead allowance under K.S.A. 59-6a215 and the required elective-share notice.Sunset helps identify accounts, debts, and real estate records so the estate settlement plan matches what actually needs court action.
Out-of-state adult child with a small estateIf the probate assets fit K.S.A. 59-1507b and there is no real estate to transfer, the small estates affidavit may collect personal property from the holder. If letters are needed, an out-of-state personal representative can serve after appointing a resident agent in Kansas under K.S.A. 59-1706, and can ask about remote appearance under Rule 103.Sunset organizes assets and helps generate the right packet, then can connect the family with a Kansas probate attorney if the Saline County filing needs counsel.
Parent settling a predeceased child's estate, home must be soldThe small estates affidavit under K.S.A. 59-1507b does not transfer the house. Ask whether refusal to grant letters under K.S.A. 59-2287, informal administration under K.S.A. 59-3301, or simplified administration under K.S.A. 59-3202 fits, and watch the six-month will rule in K.S.A. 59-617 if there is a will.Sunset helps find mortgage, tax, utility, and account information before the sale path is chosen, then helps assemble the estate settlement materials.

When to hire an attorney

Consider a Kansas probate attorney if the will deadline is close, the family disagrees, real estate must be sold, creditor issues are uncertain, the personal representative lives outside Kansas, or you are deciding among refusal to grant letters under K.S.A. 59-2287, informal administration under K.S.A. 59-3301, and simplified administration under K.S.A. 59-3202. Kansas allows fiduciary and attorney compensation that is just and reasonable under K.S.A. 59-1717, and fees can be addressed in the estate settlement. Sunset connects families with a vetted attorney.

How Sunset helps

Find the accounts and assets. Sunset searches across more than 2,300 institutions to help identify accounts, balances, insurance, retirement assets, and debts before you file in Saline County. That makes the estate settlement plan more accurate from the start.

Generate the probate packet. Sunset helps organize the information needed for Kansas forms, notices, and filing steps, including the Saline County mailing address, fax number, and probate phone line.
