Kansas venue turns on residence and real property. If the decedent lived in Kansas and owned real property in the county of residence, file there. If the decedent lived in Kansas but did not own real property in the county of residence, venue can be the county of residence or a county where the decedent owned real property. If the decedent was not a Kansas resident, venue can be any Kansas county where estate property is to be administered (K.S.A. 59-2203). If more than one case is started, the first-filed case controls while venue is decided, and a case filed in the wrong county can be transferred.
The jurisdiction process
- Find the death certificate, the will and the asset list. If the decedent was a Kansas resident and there is a will, decide quickly whether to petition for probate of the will because Kansas gives a will effect only if a petition is filed within six months after death unless a statutory saving rule applies (K.S.A. 59-617).
- If you are not ready to open an estate but need to preserve the will, ask about filing a will and affidavit under K.S.A. 59-618a. Kansas allows the will or a copy to be filed with the affidavit, and a filing made within six months after death preserves later probate of the will (K.S.A. 59-617; K.S.A. 59-618a).
- Choose the Kansas path that matches the property. A small estates affidavit under K.S.A. 59-1507b can move personal property when the probate assets do not exceed $75,000, effective July 1, 2023, but it is given to the holder of the property and does not transfer a house. Clay County real estate may require refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, or simplified administration or supervised administration as the court decides under K.S.A. 59-3202.
- Prepare the petition under the Kansas Probate Code. If you want simplified administration, ask for it in the petition and give reasons because the court decides at the hearing whether the estate is simplified or supervised (K.S.A. 59-3202).
- For a Clay County will case, follow the 21st Judicial District local rule: attach a copy of the will to the petition and also file the original will with the clerk of the district court. Kansas law also says the will accompanies the petition if it can be produced.

- After the petition is filed, the court fixes the hearing (K.S.A. 59-2222). Hearing notice is published once a week for three consecutive weeks, and required mailings go out within the Kansas timing rules (K.S.A. 59-2209). Notice to creditors is published within 30 days after filing the petition (K.S.A. 59-709).
- If there is a surviving spouse, send the required elective-share notice within 10 days when Kansas law requires it. The court hears the petition, then the court admits the will and grants letters testamentary to an executor when appropriate (K.S.A. 59-701), or grants letters of administration to an administrator when appropriate (K.S.A. 59-705).
- After letters are granted, file the inventory and valuation within 30 days unless the court gives more time (K.S.A. 59-1201). Creditors' claims are governed by the later of four months from first publication or 30 days after actual notice to a known or reasonably ascertainable creditor (K.S.A. 59-2239). Pay allowed debts and taxes, then request final settlement and a final decree assigning the estate.
