The jurisdiction process
- Gather the death certificate, the will if there is one, asset information, debt information and names and addresses for heirs, devisees and legatees. If there is a will, decide promptly whether to petition for probate or at least preserve the will within the six-month will period (K.S.A. 59-617).
- Choose the Kansas route before drafting the petition. A small estates affidavit under K.S.A. 59-1507b is furnished to the property holder for qualifying personal property, not opened as a court case. Other court routes include refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250 after the statutory waiting point, filing a will and affidavit under K.S.A. 59-618a, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
- If opening an estate, prepare the petition using the Kansas statutory requirements. A petition for administration follows K.S.A. 59-2219, and a petition for probate of a will follows K.S.A. 59-2220. If you want simplified administration, ask for it in the petition and state the reasons because the court decides under K.S.A. 59-3202.
- Add the required filing documents. A new case needs a case-filing cover sheet, and a person representing themselves must include the Self-Represented Litigant Certification Form. If you cannot pay the filing charge, ask the court about a Poverty Affidavit under K.S.A. 59-104.
- File with the clerk of the district court at 400 New York Avenue, Room 311, Holton, KS 66436 (K.S.A. 20-343). A self-represented filer may file in person, by mail, by fax to 785-364-3804, or by drop box. A drop-box filing placed by 4:00 p.m. local time counts that day.
- Pay the $131.50 probate estate docket fee, current August 2026, made up of $109.50 plus the $22 surcharge (K.S.A. 59-104), unless the court grants a fee waiver. Jackson County has no local surcharge added to that statewide probate estate amount.
- The court fixes the hearing after the petition is filed (K.S.A. 59-2222). If you need to appear by phone or video, file the Kansas Judicial Council motion and notify the other parties; the judge has discretion under Kan. Sup. Ct. R. 103.
- Give notice as ordered. Hearing notice is published once a week for three consecutive weeks and mailed within the statutory timing rules with the petition and will when required (K.S.A. 59-2209). The petitioner also gives notice to creditors under K.S.A. 59-709, and the surviving spouse receives the elective-share notice when K.S.A. 59-2233 applies.
- Attend the hearing. The court, not the clerk, admits the will, appoints the executor or administrator and grants letters testamentary under K.S.A. 59-701 or letters of administration under K.S.A. 59-705.
- After letters are granted, administer the estate. File the inventory and valuation within 30 days of the letters unless the court allows more time (K.S.A. 59-1201). Handle creditor demands under the later of four months from first publication or 30 days after actual notice for known or reasonably ascertainable creditors (K.S.A. 59-2239), pay debts and taxes, then petition for final settlement and a final decree under K.S.A. 59-2247 and K.S.A. 59-2249.
