Kansas venue depends on residence and real property (K.S.A. 59-2203). If the decedent lived in Kansas and owned real property in the county of residence, file there. If the decedent lived in Kansas but did not own real property in the county of residence, filing may be in the county of residence or a county where the decedent owned real property. For a nonresident decedent, filing may be in a Kansas county where estate property must be administered. If proceedings begin in more than one county, the first legally commenced case controls until venue is decided, and a case in the wrong county is transferred.

The jurisdiction process

  1. Find the death certificate, the will if one exists, asset information, debt information, and the names and addresses of heirs and beneficiaries. If the decedent was a Kansas resident with a will, decide quickly whether to petition for probate of the will, because a will cannot pass property unless a petition is filed within six months after death unless a savings provision applies (K.S.A. 59-617).
  2. If the family is not ready to open a full estate but needs to preserve the will, ask about filing a will and affidavit under K.S.A. 59-618a. Kansas also recognizes a small estates affidavit for personal property under K.S.A. 59-1507b, refusal to grant letters under K.S.A. 59-2287, determination of descent under K.S.A. 59-2250, informal administration under K.S.A. 59-3301, and simplified or supervised administration under K.S.A. 59-3202.
  3. Prepare the petition required for the chosen court route. If you want simplified administration, the petition must ask for it and give reasons, because the court decides that issue under K.S.A. 59-3202.
  4. Add the required case-filing cover sheet. If you are filing without a lawyer, add the Self-Represented Litigant Certification Form. If you cannot afford the docket fee under K.S.A. 59-104, ask whether a Poverty Affidavit under K.S.A. 59-104 is available for the filing.
  5. File with the clerk of the district court in Barber County (K.S.A. 20-343). A self-represented filer may file in person at 118 E Washington in Medicine Lodge, by mail, by fax to 620-886-5854, or in the courthouse drop box. The docket fee under K.S.A. 59-104 for opening a probate estate is $131.50, effective July 1, 2026 through June 30, 2030.
  6. The court fixes the hearing after the petition is filed (K.S.A. 59-2222). If appearing in Medicine Lodge is difficult, file a motion asking to appear by phone or video under Kan. Sup. Ct. R. 103, Rule 103 and notify the other parties.
  7. Give the required notice. Hearing notice is published once a week for three consecutive weeks, and mailed within seven days after first publication with the petition and will when required (K.S.A. 59-2209). Notice to creditors is published within 30 days after filing the petition (K.S.A. 59-709).
  8. At the hearing, the judge decides whether to admit the will, appoint the personal representative, and grant letters testamentary to an executor named in a will or letters of administration to an administrator when there is no will or no executor can serve (K.S.A. 59-701, K.S.A. 59-705).
  9. After letters are granted, file the inventory and valuation within 30 days unless the court allows more time (K.S.A. 59-1201). Manage assets, give required creditor notice, pay valid debts and taxes, and track the claim period, which is the later of four months from first publication or 30 days after actual notice for known or reasonably ascertainable creditors (K.S.A. 59-2239).
  10. When administration is ready to close, file the petition for final settlement and accounting. The court enters a final decree assigning the estate, and real estate assignments are placed on the county clerk's transfer record as required by K.S.A. 59-2247 and K.S.A. 59-2249.
