That list determines whether you need a Wells Circuit Court estate case, whether an Indiana small estate affidavit may work, and what the personal representative will need to manage after appointment.

Which court handles jurisdiction

The Wells County courthouse in Bluffton serves the whole county for probate filings. Wells County is its own twenty-eighth judicial circuit, and Wells County local rule LR90-AR01-1(B) assigns estate cases to the Wells Circuit Court.

Indiana venue is based on the decedent's domicile. If the decedent was domiciled in Wells County at death, the probate of the will and the administration of the estate belong in Wells County (IC 29-1-7-1). Wells County is also part of Judicial District 9 with Adams, Huntington and Wabash counties, but that district is administrative and does not change the Wells County filing counter or venue rule.

The jurisdiction process

  1. Choose the right path before filing. If you need court authority, prepare the petition for probate of will and issuance of letters testamentary, or the petition for letters of general administration. If the estate qualifies for Indiana's small estate affidavit route, the statewide affidavit is presented to the holder of property rather than filed with the Wells County Clerk (IC 29-1-8-1, June 30, 2022).
  2. File at the Wells County Clerk's office, 102 W Market Street, Suite 201, Bluffton. Wells County's caseload allocation rule sends estate cases to the Wells Circuit Court.
  3. Pay the statewide court costs for the filing you are making. In 2026, opening an estate with a petition for letters is $177 under IC 33-37. Sheriff service adds $28 in 2026 if collected, under IC 33-37-5-15. A will-only offering is not the same filing and is addressed separately by IC 33-37-4-7(c)(3).
  4. After letters issue, publish the notice of administration and serve required notices. Indiana requires publication once each week for two consecutive weeks, with proof filed with the clerk within 30 days after publication (IC 29-1-7-7).
  5. Watch the creditor deadline. Claims generally must be filed within three months after the first published notice, or within nine months after death, whichever is earlier, or they are forever barred (IC 29-1-14-1).
  6. Schedule and attend any required hearing in the Wells Circuit Court. For remote participation, ask the court when the hearing is set. Indiana allows remote non-testimonial hearings at the court's discretion, and testimony is handled under Ind. Administrative Rule 14.
  7. Obtain the authority document after the court appoints the personal representative. Indiana uses letters testamentary for a named executor under a will and letters of general administration for an administrator.
  8. Administer and close the estate. The personal representative gathers assets, prepares the inventory within the required time, pays valid claims and expenses, distributes property, and files the proper closing statement or final settlement papers. Probate forms in Wells County

Wells County does not publish a local probate packet, cover sheet, checklist or prescribed probate form in its local rules or on the county clerk pages identified for this court. Estate filings are still assigned to the Wells Circuit Court under LR90-AR01-1(B), but the form set is not a separate Wells County packet.

Indiana also does not publish a statewide court-approved probate form set for full estate administration. The statewide estate self-help form most families encounter is Indiana Legal Help's small estate affidavit, CCA-EM-0722-5000. That affidavit is for transfer of assets without administration and is given to the bank, insurer or other property holder, not filed with the Wells County Clerk (IC 29-1-8-1, June 30, 2022).
