Which court handles jurisdiction

Clay County has one courthouse in Brazil serving the whole county. Venue for probating a will and administering an estate is the Indiana county where the decedent was domiciled at death (IC 29-1-7-1). If the decedent was domiciled in Clay County, the estate is filed with the Clay County Clerk and assigned to the Clay Circuit Court under LR11-AR01-2(D).

Clay County is in Judicial District 19 with Putnam, Sullivan and Vigo counties for court-administration purposes. That district grouping does not change probate venue, and it does not move a Clay County estate to another county's clerk or court.

The jurisdiction process

  1. Decide whether a court estate is needed. Indiana's small estate affidavit applies only when the gross probate estate fits the $100,000 limit for deaths after June 30, 2022 under IC 29-1-8, and that affidavit is given to the property holder rather than filed with the court.
  2. Prepare the opening papers for the correct Indiana estate case type. Clay County does not publish a separate fill-in probate packet, so the petition, proposed orders, notices and any bond documents must meet Indiana law and Clay County Local Rules LR11-PR-1 through LR11-PR-10.
  3. File with the Clay County Clerk at the Clay County Courthouse, 609 East National Avenue, Room 209, Brazil. Clay County's caseload rule directs the clerk to assign estate cases to the Clay Circuit Court.
  4. Pay the court costs that apply to the filing. A petition to open an estate carries $177, current through the 2026 Legislative Session, under IC 33-37. If sheriff service is requested, add $28, current through the 2026 Legislative Session, under IC 33-37-5-15.
  5. Address bond before letters issue. Clay County Local Rule LR11-PR-3 requires a corporate surety bond before letters issue unless the court applies a waiver, reduction or restricted-account alternative under the local rule.
  6. Handle notice. Under LR11-PR-1, the attorney, when one is involved, prepares publication and mailed notices and must be able to prove service before bringing the matter to the court. Indiana notice and creditor-claim rules still apply.
  7. Attend any required hearing or respond to the court's order. Clay County does not publish a probate hearing-day schedule in the local rules. For remote participation, ask the court because Ind. Administrative Rule 14 leaves most non-testimonial remote hearings to the court's discretion.
  8. Receive letters testamentary or letters of general administration if the court appoints a personal representative. Letters issued by the clerk under the court's seal are evidence of the personal representative's authority (IC 29-1-10-4).
  9. File the Clay County inventory. Unlike the statewide rule that generally requires preparation within two months, Clay County Local Rule LR11-PR-4 requires the fiduciary to file an inventory in every estate, supervised or unsupervised, within sixty days after appointment.
  10. Administer, account and close the estate. Follow Clay County rules for real estate sales or distributions, accountings and fee review. In an unsupervised estate settlement, the personal representative closes by filing the statutory closing statement when the estate is ready and the timing requirements are met.
