Which court handles jurisdiction

Huntington County has one courthouse in Huntington. Huntington County constitutes the fifty-sixth judicial circuit (IC 33-33-35-1), and it also has a standard superior court established under IC 33-29-1 (IC 33-33-35-2). For local probate operations, Huntington's caseload allocation rule controls: LR 35-00-16 assigns estate cases to the Huntington Circuit Court.

File in Huntington County when the decedent was domiciled in Huntington County at death. Indiana venue for probating a will and administering an estate is the county where the decedent was domiciled at death, or, for a nonresident decedent, an Indiana county where the decedent left property (IC 29-1-7-1).

The jurisdiction process

  1. Choose the correct starting papers. If there is a will and you need a personal representative, prepare a petition for probate of will and issuance of letters testamentary. If there is no will, prepare a petition for letters of general administration. If e-filing a will copy, follow Ind. Trial Rule 87(E) for the copy, affidavit and retention of the original will.
  2. File with the Huntington County Clerk at 201 N. Jefferson Street, Room 201, Huntington, IN 46750. Attorneys use the IEFS. An unrepresented filer may use the IEFS or contact the clerk about conventional filing at the counter.
  3. Pay the required court costs for the filing you are making. A petition that opens an estate and seeks letters is $177 statewide, current through the 2026 Legislative Session (IC 33-37-4-7, IC 33-37-5). Some limited filings, including offering a will for probate without more, are treated separately under IC 33-37-4-7(c).
  4. The case is assigned to the Huntington Circuit Court under LR 35-00-16. If the court sets a hearing, ask the clerk or court staff whether the hearing will be in person or whether a remote appearance may be requested under Ind. Administrative Rule 14.
  5. After letters testamentary or letters of general administration issue, publish notice of the estate administration once each week for two consecutive weeks and file proof of publication with the clerk within 30 days after publication (IC 29-1-7-7).
  6. Serve required notice on heirs, devisees, legatees and known or reasonably ascertainable creditors. Indiana claims are generally filed within three months after first publication or within nine months after death, whichever is earlier, or they are forever barred (IC 29-1-7-7, IC 29-1-14-1).
  7. Administer the estate. The personal representative gathers assets, prepares the inventory on the Indiana timeline, pays allowed claims and expenses, handles any real estate issues and distributes the remaining property.
  8. Close the estate. In an unsupervised administration, the personal representative files a closing statement no earlier than three months after the first published creditor notice (IC 29-1-7.5-4). In a supervised estate, the court directs final settlement before the estate settlement is complete.

Huntington County does not publish a local probate packet, local cover sheet, probate checklist or required local probate form in its local rules or on the county Clerk pages reviewed for this page. The only Huntington-specific probate directive in the local rules is the caseload assignment to the Huntington Circuit Court in LR 35-00-16.

Indiana does not provide a statewide court-approved probate form set for full estate administration. The statewide Indiana Legal Help small estate affidavit, CCA-EM-0722-5000, is for eligible estates under IC 29-1-8 and, for deaths after June 30, 2022, uses a $100,000 ceiling. That affidavit is given to the bank, company or other asset holder, not filed with the Huntington County Clerk.
