The jurisdiction process

  6. The case is assigned to the Blackford Circuit Court under LR05-AR1(E)-6. If the court sets a hearing, ask the Circuit Court about appearance instructions. Non-testimonial hearings may be remote at the court's discretion, while testimonial hearings are in person unless good cause or party agreement supports remote participation under Ind. Administrative Rule 14.
  7. After the court appoints a personal representative, letters testamentary or letters of general administration provide evidence of authority to act for the estate (IC 29-1-10-1, IC 29-1-10-4).
  8. Publish and serve the notice of administration as Indiana law requires. Claims generally must be filed within three months after first publication or within nine months after death, whichever is earlier, or they are forever barred (IC 29-1-7-7, IC 29-1-14-1).
  9. Administer and close the estate. The personal representative prepares the inventory within two months after appointment, pays allowed claims, handles property and distributions, and closes through the proper closing statement or court approved settlement. Blackford County has no local probate rule adding a different inventory filing requirement, so the statewide prepare duty controls (IC 29-1-12-1, IC 29-1-7.5-3.2). This final stage is where estate settlement work becomes complete.

Blackford County does not publish a local probate packet, cover sheet, checklist or prescribed probate form in its local rules or county department pages. The county's local rules also do not include a PR00 probate rule family.

Indiana does not have a statewide court-approved probate form set. Indiana Legal Help publishes one estate self-help form, the small estate affidavit CCA-EM-0722-5000. For deaths after June 30, 2022, that form is used only when the gross probate estate, less liens, encumbrances and reasonable funeral expenses, is $100,000 or less under IC 29-1-8. It is presented to the holder of the property, such as a bank, and is not filed with the Blackford County Clerk.
