If the decedent was domiciled in Jennings County, file the estate in Jennings County.
Jennings County constitutes the eighty-sixth judicial circuit, and it also has the Jennings Superior Court. Local rule LR40-AR8-01 assigns estate, trust and guardianship case types to the Jennings Circuit Court. The Clerk of the Circuit Court is the filing officer for both courts under Indiana's one-clerk structure (IC 33-32-2-1).
The jurisdiction process
- Choose the filing path. Identify whether you are offering a will only, asking for letters testamentary, asking for letters of general administration, or using a smaller non-court transfer option. If the estate uses Indiana's small estate affidavit, the $100,000 limit applies to deaths after June 30, 2022, under IC 29-1-8, and the form is presented to the holder of property rather than filed with the court.

If sheriff service is collected, the total is $205, including the $28 service fee under IC 33-37-5-15, current through 2026. - Handle the original will correctly if filing electronically. Under Ind. Trial Rule 87(E), a user who files a copy of a will for probate files an affidavit about the original will and retains the original until the estate is closed and the personal representative is released from liability, or until the time to contest the will has expired, unless the court or statute directs otherwise.
- Give and publish notice after letters issue. Indiana requires notice of estate administration to be published once each week for two consecutive weeks, and proof of publication is filed with the clerk within 30 days after publication (IC 29-1-7-7). Creditor claims are governed by the three-month and nine-month limits in IC 29-1-14-1.
- Schedule any hearing through the court. Jennings County does not publish a standing probate hearing day. Ask the Jennings Circuit Court or clerk how the judge schedules the particular estate filing.
- Ask about remote appearance before the hearing. Jennings County does not publish a local probate remote-appearance rule. Under Ind. Administrative Rule 14, non-testimonial hearings may be remote at the court's discretion, while testimonial proceedings are in person unless there is good cause or agreement.
- Receive letters and administer the estate. Once the court appoints the personal representative, the clerk issues letters testamentary or letters of general administration, which are evidence of authority under IC 29-1-10-4.
- Prepare the inventory and close the estate. Indiana requires the personal representative to prepare an inventory within two months after appointment in supervised and unsupervised estates (IC 29-1-12-1, IC 29-1-7.5-3.2). Jennings County has no local rule adding an inventory filing deadline. Finish the estate settlement through the appropriate closing statement or final settlement procedure.
