The jurisdiction process

  1. Decide whether a court administration is needed. If the estate can use Indiana's small estate affidavit route, the statewide affidavit is presented to the property holder and is not filed with the court. For deaths after June 30, 2022, that route uses the $100,000 gross probate estate test in IC 29-1-8.
  2. Prepare the opening documents for the correct Indiana path. In a testate estate, this usually includes the will and a petition asking for probate of the will and letters testamentary. In an intestate estate, the filing asks for letters of general administration. Indiana does not publish a statewide court-approved probate packet for full administration.
  3. File with the Vermillion County Clerk at 255 South Main in Newport, or use IEFS if filing electronically. Attorneys file through IEFS. Unrepresented litigants may use IEFS but are not required to do so (Ind. Trial Rule 87).
  4. Pay the court costs for the opening petition. The statewide amount for a petition for letters is $177 under IC 33-37 and the Indiana Trial Court Fee Manual, current through the 2026 Legislative Session. If sheriff service is requested, add the $28 sheriff service fee under IC 33-37-5-15.
  5. Follow the court's direction on any hearing or order. Vermillion County has one circuit court, so the case stays within the Vermillion Circuit Court rather than being assigned among multiple trial courts.
  6. Publish and serve notice after letters issue. Indiana requires notice of administration to be published once each week for two consecutive weeks, with proof filed with the clerk within 30 days after publication (IC 29-1-7-7).
  7. Use the authority document issued by the court. Letters testamentary or letters of general administration, attested by the clerk and under the court seal, are conclusive evidence of the personal representative's authority until superseded or revoked (IC 29-1-10-4).
  8. Administer the estate. The personal representative gathers assets, prepares the inventory required by Indiana law, handles creditor claims, pays expenses, manages real estate issues and distributes remaining assets to the proper distributees.
  9. Close the estate. In an unsupervised administration, the personal representative files the closing statement no earlier than three months after the first published notice to creditors (IC 29-1-7.5-4). Supervised matters close through the court process the judge requires.

Probate forms in Vermillion County

Vermillion County does not publish a local estate packet, cover sheet, checklist or probate form for a full administration, and the county's current local rules do not prescribe an estate-specific form. Fees

Vermillion County has one local cost item in its current local rules. LR83-TR5-1 allows fax filings that meet the rule's page limit and timing requirements and sets a fax filing charge of $1.00 per page, up to $10.00 per transmission, under the local rules amended effective April 28, 2025. Court-appointed attorneys and guardians ad litem are exempt under the same rule.

The fax filing number in the local rule is 1-765-492-5351, and the rule applies only to fax filings received from 8:00 a.m. to 4:00 p.m. Monday through Friday. The clerk's general fax number is different.
