Which court handles jurisdiction

Ripley County has one courthouse filing point for probate matters, the Ripley County Clerk at 115 N. Main Street in Versailles. The Clerk of the Circuit Court serves the Circuit Court and Superior Court under IC 33-32-2-1, so you start with the same clerk even though Indiana trial courts can have both circuit and superior courts.

Ripley County constitutes the eightieth judicial circuit and has a standard superior court, but neither statute assigns estate cases by itself. Ripley's local caseload rule assigns miscellaneous estates, unsupervised estates, supervised estates, trusts and guardianships to the Ripley Circuit Court. Ripley County is in Judicial District 22 with Dearborn, Jefferson, Ohio and Switzerland counties for court administration, but that district does not change venue. Venue for probate of a will and administration of an estate is the Indiana county where the decedent was domiciled at death, or, for a nonresident decedent, an Indiana county where property is located (IC 29-1-7-1).

The jurisdiction process

  1. Identify the estate path before filing. If administration is needed in Ripley County, prepare the petition for probate of will and letters testamentary, or the petition for letters of general administration, plus the death certificate, will if there is one and the information needed for heirs, devisees, creditors and assets.
  2. File with the Ripley County Clerk at 115 N. Main Street in Versailles, or use the Indiana E-Filing System if you are filing electronically. Attorneys must e-file unless exempted, while unrepresented litigants may file conventionally under Ind. Trial Rule 87.
  3. Pay the 2026 court cost for the estate opening if one is due. A petition for letters is $177 under IC 33-37, and sheriff service adds $28 if needed under IC 33-37-5-15. Offering a will for probate alone is treated differently and may be exempt from court costs under IC 33-37-4-7(c)(3).
  4. The case is assigned under Ripley's caseload allocation rule to the Ripley Circuit Court. If the filing asks for appointment of a personal representative, the court reviews the petition and any required consents, bond issues or notices.
  5. After letters testamentary or letters of general administration are issued, publish notice of administration once each week for two consecutive weeks and file proof of publication with the clerk within 30 days after publication, as required by IC 29-1-7-7.
  6. Serve required notices on heirs, devisees, legatees and known creditors. Claims generally must be filed within three months after first publication or within nine months after death, whichever is earlier, or they are forever barred under IC 29-1-14-1.
  7. Prepare the inventory within the statewide deadline. Ripley County does not publish a local rule requiring a different inventory filing practice, so follow the Indiana inventory rules and any order entered in the case (IC 29-1-12-1, IC 29-1-7.5-3.2).
  8. Use the letters to collect assets, manage accounts, sell property if authorized, pay valid claims and expenses and distribute the remaining property. For a real property sale to pay debts or administration costs, watch the statewide five-month petition and seven-month letters rule in IC 29-1-7-15.1(b).
  9. Close the estate by the correct Indiana closing procedure. In an unsupervised estate, the personal representative files a closing statement no earlier than three months after the first published notice to creditors under IC 29-1-7.5-4. Supervised matters may require court approval or a final settlement process.

Probate forms in Ripley County

Ripley County does not publish a local probate packet, cover sheet, checklist or required local probate form in its current local rules or county pages. The local rules also do not include an LR69-PR00 probate rule family.

Indiana does not publish a statewide court-approved probate form set for opening a regular estate. Indiana Legal Help publishes one statewide estate self-help form, the small estate affidavit CCA-EM-0722-5000, for qualifying estates with a gross probate estate of $100,000 or less for deaths after June 30, 2022 under IC 29-1-8. That affidavit is given to the bank or other holder of property and is not filed with the Ripley County court.
