Before you begin — know the assets and liabilities
Before you file anything in Parke County, identify the decedent's probate assets, non-probate transfers, known debts, funeral expenses and any real estate that may need court authority to sell. The choice between a small estate affidavit, unsupervised administration and supervised administration depends on the assets and the authority you need, not just whether there is a will.
Sunset's estate settlement platform helps families search across more than 2,300 institutions for accounts and assets, organize liabilities, and understand what may need letters testamentary or letters of general administration from the Parke Circuit Court.
Which court handles jurisdiction
The Parke Circuit Court in Rockville serves estate matters venued in Parke County. Parke County constitutes the sixty-eighth judicial circuit, and Parke County has no superior court, so there is no separate court-assignment question for a Parke County estate.
Indiana venue is based on the county where the decedent was domiciled at death. If the decedent was not domiciled in Indiana, venue may be in a county where the decedent left property or where estate property later came (IC 29-1-7-1).
The jurisdiction process
- Decide what authority is needed. If assets can move without a court case, the statewide small estate affidavit may be enough. If a personal representative needs authority, prepare a petition for probate of will and issuance of letters testamentary, or a petition for letters of general administration.
- Use the Parke Circuit Court filing counter. File estate petitions with the Clerk of the Circuit Court at 116 West High Street, Room 204, Rockville, Indiana. The Parke Circuit Court is in the same courthouse, Room 201.
- Pay the court costs that apply to the filing. A petition for letters is $177 under IC 33-37-4-7 and IC 33-37-5, current through the 2026 Indiana Trial Court Fee Manual. Offering a will for probate without any other proceeding has no court costs under IC 33-37-4-7(c)(3).
- Follow Parke County's local notice rules. When publication or mailed notice is required, Parke Local Rule 9 says the attorney prepares the notice, ensures service, and shows adequate proof of service before the matter comes before the court (LR61-PR00-9.1). Copies of petitions must go with notices when the hearing arises from a petition (LR61-PR00-9.2).
- Serve creditor and estate-opening notices as required. Parke Local Rule 9 calls for notice of the opening of an estate by first-class United States Mail to readily ascertainable creditors, with certified mail recommended (LR61-PR00-9.3). State law separately requires publication of notice of administration and sets the creditor-claim deadline.
- Ask the court about hearing format when a hearing is needed. Indiana courts may conduct non-testimonial proceedings remotely at the court's discretion, while testimonial proceedings are generally in person unless good cause or agreement supports remote participation (Ind. Administrative Rule 14).
- Receive the authority document. After the court appoints the personal representative, the clerk issues letters testamentary or letters of general administration. Those letters are the proof of authority to collect assets, deal with institutions, sell estate property when allowed, and administer the estate (IC 29-1-10-4).
- Administer and close the estate settlement. The personal representative gathers probate assets, handles required notices, pays allowed claims and expenses, distributes remaining property, and closes the estate through the Indiana procedure that applies to the case.
Forms and documents
Probate forms in Parke County
Parke County does not publish a county-specific probate packet in its local probate rules. The local rules instead set requirements for notices, petition copies and proof of service in probate matters (LR61-PR00-9.1 through LR61-PR00-9.4). A petition should be drafted for the estate and should satisfy Indiana law and the Parke Circuit Court's local rules.
Indiana does not have a statewide court-approved probate form set for opening a full estate. Indiana Legal Help does publish one statewide estate form, CCA-EM-0722-5000, the small estate affidavit. That affidavit is for qualifying estates with a gross probate estate not above $100,000 for deaths after June 30, 2022 (IC 29-1-8-1). It is presented to the bank or other asset holder, not filed with the Parke Circuit Court.
If you are filing without a lawyer, call the Clerk of the Circuit Court at (765) 569-5132 before going to the courthouse to ask what the court expects with a self-represented estate petition.
Local nuance
Parke County-specific considerations
| Local rule or practice | What it means in Parke County |
|---|---|
| Single trial court | Parke County has no superior court. Estates are handled in the Parke Circuit Court. |
| Notice preparation | When publication or mailed notice is required, Parke Local Rule 9 places notice preparation and service responsibility on the attorney, and adequate proof of service must be shown before the matter comes before the court (LR61-PR00-9.1). |
| Petition copies with notices | Copies of petitions must be sent with all notices when the hearing arises from matters in the petition (LR61-PR00-9.2). |
| Creditor notice practice | Notice of the opening of an estate is sent by first-class United States Mail to readily ascertainable creditors, with certified mail recommended (LR61-PR00-9.3). |
| Insolvent estate hearing notice | Notice of a hearing to determine an estate insolvent must be served on all interested parties under Parke Local Rule 9 (LR61-PR00-9.4). |

For estates, it begins with a $500 basic attorney fee under the local rules reviewed in August 2026, then applies a percentage layer that steps down as the estate grows. Fees above the guideline require a petition and court approval. |

Scenarios
| Situation | Parke County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with a co-owned home | First confirm how the home is titled and whether it passes outside probate. If Parke County court authority is still needed for probate assets, file the estate petition with the Clerk of the Circuit Court in Room 204 at the Rockville courthouse. | Sunset helps separate jointly owned assets from probate assets, organize account information, and prepare an estate settlement plan before a Parke County filing. |
| Out-of-state adult child with a small estate | If the estate qualifies, the statewide small estate affidavit may be presented to asset holders after the statutory waiting period instead of opening a Parke County estate. If letters are needed, a nonresident personal representative may serve in Indiana by filing the required acceptance, appointing a resident agent, and addressing bond as required by IC 29-1-10-1(d). | Sunset helps identify whether assets require court authority, gathers institution details, and connects you with Indiana counsel if the Parke Circuit Court filing is the better route. |
| Parent settling predeceased child's estate, home must be sold | Real estate can make timing important. Indiana limits a personal representative's ability to sell real property to pay certain debts or administration costs unless the petition and letters issue within the statutory five-month and seven-month windows (IC 29-1-7-15.1(b)). File promptly in Parke Circuit Court if a sale may be needed. | Sunset helps locate mortgages, liens, taxes, accounts and other estate information so the sale decision fits the full estate settlement picture. |
