Venue is based on the decedent's domicile. If the decedent was domiciled in Rush County at death, Rush County is the venue for probate of the will and administration of the estate (IC 29-1-7-1). If the decedent was not domiciled in Indiana, venue may be in an Indiana county where the decedent left property or where property later came (IC 29-1-7-1).

The jurisdiction process

  1. Identify the probate assets, debts, heirs, beneficiaries and any will. If a will is being e-filed, Trial Rule 87(E) requires an accurate copy and an affidavit about possession or deposit of the original will, with the original retained or filed as directed by the court.
  2. Prepare the petition for probate of will and issuance of letters testamentary, or the petition for letters of general administration if there is no will. Call the Clerk's Office at (765) 932-2086 to ask whether the assigned court wants a local cover sheet or proposed order format.
  3. File the case with the Clerk of the Circuit Court at 101 E. 2nd Street, Room 209, Rushville. The Clerk serves both the Circuit Court and the Superior Court (IC 33-32-2-1), and LR70-AR00-1 assigns estate cases on an equal random basis between them.
  4. Pay the statewide court-cost total that applies to a petition for letters, generally $177 in 2026 (IC 33-37-4-7, IC 33-37-5). Do not assume that every will-related filing has that cost, because offering a will alone is treated differently under IC 33-37-4-7(c).
  5. After letters testamentary or letters of general administration issue, publish notice of administration once each week for two consecutive weeks and file proof of publication with the clerk within 30 days after publication (IC 29-1-7-7). Serve required notices through the E-filing System or by first class mail as the statute directs.
  6. If the court sets a hearing, call the court that received the random assignment. Non-testimonial hearings may be remote at the court's discretion, and testimonial hearings are in person unless good cause or party agreement supports a remote proceeding (Ind. Administrative Rule 14).
  7. Use the letters issued by the clerk under the court's seal as proof of the personal representative's authority (IC 29-1-10-4). The personal representative then gathers assets, prepares the inventory within the statutory period, handles creditor claims and carries out the estate settlement.
  8. Close the estate through the correct Indiana closing route. In an unsupervised administration, the closing statement cannot be filed earlier than three months after the first published notice to creditors (IC 29-1-7.5-4). The closing step is where the estate settlement is documented for the court and the distributees.
