Before you begin — know the assets and liabilities

Before you file in Harrison County, make a practical list of the decedent's assets, debts, account holders, real estate, vehicles, beneficiary designations and jointly owned property. That first inventory of what exists will drive whether the estate needs a petition for letters, whether the Indiana small estate affidavit can be used, and whether the Harrison Circuit Court needs to supervise any part of the process.

Sunset can support estate settlement by helping families search across more than 2,300 financial institutions for accounts and assets, organize debts and beneficiary information, and turn that information into the packet a personal representative and attorney can review before filing in Corydon.

Which court handles jurisdiction

Harrison County probate matters are filed for decedents whose proper Indiana venue is Harrison County. Indiana venue is the county where the decedent was domiciled at death, or, for a non-Indiana domiciliary, a county where the decedent left property or where estate property later came (IC 29-1-7-1).

Harrison County constitutes the third judicial circuit. The county also has a standard superior court, but the county's current caseload allocation plan assigns EM, ES, EU, guardianship and trust case types to the Harrison Circuit Court (LR31-AR-1(E)-19). The Clerk of the Circuit Court serves as clerk for the county's trial courts, so the courthouse filing counter in Corydon remains the practical starting point (IC 33-32-2-1).

The jurisdiction process

  1. Identify the probate assets, known debts, heirs, devisees, beneficiary designations, jointly owned assets and any Harrison County real estate before choosing the filing path.
  2. If a full estate is needed, prepare the petition for probate of will and issuance of letters testamentary, or the petition for letters of general administration. If the will is e-filed, Indiana Trial Rule 87(E) requires a complete copy of the will and an affidavit about possession and retention of the original will.
  3. File the estate papers with the Clerk of the Circuit Court at the Harrison County Courthouse in Corydon, or through an approved IEFS provider if filing electronically. Attorneys file through the IEFS unless exempted. Unrepresented litigants may use the IEFS but are not required to do so (Ind. Trial Rule 87).
  4. Pay the required court cost for the filing. A petition for probate of will and issuance of letters, or a petition for letters of general administration, is $177 under IC 33-37-4-7 and IC 33-37-5, current through the 2026 Legislative Session. If sheriff service is collected, the total is $205, including the $28 sheriff service fee under IC 33-37-5-15, current through the 2026 Legislative Session.
  5. After letters issue, publish notice of administration once each week for two consecutive weeks and file proof of publication with the clerk within 30 days after publication. Serve heirs, devisees, legatees and known creditors as Indiana law requires (IC 29-1-7-7).
  6. Use the court's scheduling instructions for any hearing. Harrison County local rules do not publish a probate hearing day, so ask the clerk how the assigned Harrison Circuit Court hearing is set.
  7. Once the court appoints the personal representative, obtain letters testamentary or letters of general administration. Those letters are the clerk-attested proof of authority to act for the estate (IC 29-1-10-4).
  8. Administer the estate by collecting assets, preparing the inventory required by Indiana law, paying allowed claims and expenses, handling any sale or transfer of property, and making distributions.
  9. Close the estate by the correct Indiana method, such as an unsupervised closing statement or a supervised final settlement, so the estate settlement reaches a formal endpoint.

Forms and documents

Probate forms in Harrison County

Harrison County does not publish an online estate packet or local probate checklist. Indiana also does not have a statewide court-approved probate form set for ordinary estate administration. For a Harrison County estate, the petition is usually drafted for the facts of the case, and the Clerk's Office should be asked what cover sheet or local counter practice applies.

Indiana Legal Help publishes one statewide estate form, CCA-EM-0722-5000, the small estate affidavit for transfer of assets without administration. It is for qualifying estates with a gross probate estate of $100,000 or less for deaths after June 30, 2022, under IC 29-1-8, and it is presented to the bank or other holder of the asset rather than filed with the Harrison Circuit Court.

Scenarios

ScenarioLikely Harrison County pathWhere Sunset helps
Surviving spouse with co-owned homeStart by identifying how the home is titled, what assets are in the decedent's name alone, and whether a Harrison County estate is needed. If letters are needed, the estate case is filed through the Clerk of the Circuit Court and assigned to the Harrison Circuit Court under LR31-AR-1(E)-19.Sunset helps organize the title questions, account search, debts and family information so the spouse and attorney can decide whether a court estate is needed.
Out-of-state adult child with small estateCheck whether the Indiana small estate affidavit route applies. If the gross probate estate is $100,000 or less for a death after June 30, 2022, and the other IC 29-1-8 requirements are met, the affidavit is given to the asset holder rather than filed in Corydon.Sunset helps locate accounts, estimate date-of-death values and assemble the information needed to compare the small estate route with a petition for letters.
Parent settling predeceased child's estate, home must be soldIf a sale of Indiana real property may be needed to pay debts or administration costs, timing matters because Indiana has a five-month petition and seven-month letters rule for certain sales (IC 29-1-7-15.1(b)). In Harrison County, the estate filing is made through the clerk and assigned to the Harrison Circuit Court.Sunset helps gather mortgage, deed, account and creditor information and can connect the parent with local probate counsel before sale deadlines become a problem.
