Before you begin — know the assets and liabilities
Before you file anything in Covington, list the decedent's probate assets, known debts, real estate, jointly owned property, beneficiary-designated accounts and likely creditors. That first inventory drives the local path, because a supervised Fountain County estate has a 60-day filed-inventory rule and the court's real-estate sale rules require appraisal paperwork when supervised property must be sold.
Sunset's 2,300-institution asset discovery can help identify accounts before you choose a small-estate route, unsupervised administration or supervised administration. A clearer asset picture also helps avoid reopening an estate settlement after the personal representative believes the estate is complete.
Which court handles jurisdiction
File a Fountain County estate at the Fountain County Courthouse in Covington when Indiana venue belongs in Fountain County. Indiana venue for probate of a will and administration of an estate is the county where the decedent was domiciled at death, or, for a non-Indiana domiciliary, a county where the decedent left property or where estate property later came (IC 29-1-7-1).
Fountain County constitutes the sixty-first judicial circuit, and Fountain County has no superior court. The Fountain Circuit Court is the only trial court for estates in the county. The Clerk of the Circuit Court serves the circuit court and is the filing office for estate matters (IC 33-32-2-1).
The Indiana Judicial Branch places Fountain County in Judicial District 11 with Montgomery, Parke, Vermillion and Warren Counties. That district is an administrative grouping, not the probate venue rule.
The jurisdiction process
- Decide whether court administration is needed. If the estate can use Indiana's small estate affidavit, the affidavit is presented to the bank or other holder rather than filed with the Fountain Circuit Court. If letters are needed, continue with the court process.
- Prepare the opening petition and supporting papers for the Fountain Circuit Court. Under LR23-PR00-2, pleadings must include the attorney's name, address, phone and attorney number when an attorney appears, and the initial petition must include required fiduciary identifying information.
- File with the Clerk's Office at the Fountain County Courthouse in Covington or through the Indiana E-Filing System if using e-filing. Attorneys file through the Indiana E-Filing System; unrepresented litigants may use it but are not required to do so under Ind. Trial Rule 87.
- Pay the court costs owed for the specific filing. A petition for letters testamentary or letters of general administration is $177 under IC 33-37, current through the 2026 Legislative Session. Offering a will for probate alone carries no court costs fee under IC 33-37-4-7(c)(3).
- Handle notice. Fountain County LR23-PR00-1 makes the attorney responsible for preparing notice and ensuring proper publication and service. Notice of the opening of an estate is sent by regular U.S. mail to all readily ascertainable creditors under the local rule, while Indiana's statewide notice and creditor-claim rules also apply (IC 29-1-7-7, IC 29-1-14-1).
- Address bond and appointment. Fountain County LR23-PR00-3 leaves bond to the court's discretion in unsupervised administration and generally requires bond in supervised estates based on personal property plus estimated annual rents and profits, with local exceptions.
- Receive authority after the court appoints the personal representative. Indiana letters testamentary or letters of general administration, attested by the clerk and under the court seal, are evidence of the personal representative's authority (IC 29-1-10-4).
- Administer the estate under Fountain County's local rules. In supervised estates, file the inventory within 60 days after appointment under LR23-PR00-4, follow the appraisal and sale rules for real estate and personal property under LR23-PR00-5 and LR23-PR00-6, and file intermediate accounts when required by LR23-PR00-7.
- Close the estate. Unsupervised estates close by statutory closing statement when the requirements are met, while supervised estates may require court approval of accounts, fees, sales and distribution. The closing step is where estate settlement becomes final for practical purposes.
Executor duties
| Local duty | Fountain County rule |
|---|---|
| Notice work | LR23-PR00-1 places preparation, publication and service of notice on the attorney, and notice of opening an estate goes by regular U.S. mail to all readily ascertainable creditors. |
| Bond | LR23-PR00-3 allows service without bond only at the court's discretion. In supervised estates, bond is generally based on estate personal property plus estimated annual rents and profits, subject to local exceptions. |
| Inventory in supervised estates | LR23-PR00-4 requires the fiduciary to file an inventory in all supervised estates within 60 days after appointment. |
| Real estate sales in supervised estates | LR23-PR00-5 requires a written appraisal with a petition to sell real estate unless the appraisal was filed with the inventory. Sales must close within six months after the petition is filed or a current appraisal must be refiled. |
| Personal property sales | LR23-PR00-6 applies similar appraisal and timing rules to personal property, with an exception for readily valued market assets such as stocks and bonds. |
| Accounts | LR23-PR00-7 requires an intermediate account 30 days after the estate has been open one year, and each year after that if the estate remains open. |
| Fees in supervised estates | LR23-PR00-8 says no attorney or fiduciary fee is paid in a supervised estate without a prior written court order. Fee petitions must follow the court's fee-guideline appendix, but no figures are listed here. |
| Claims review | LR23-PR00-10 requires the fiduciary to examine claims and allow or disallow them within 5 months and 15 days after first published notice. |
Forms and documents
Probate forms in Fountain County
Probate petitions in Fountain County are drafted for the specific estate. The county's LR23-PR00 rules set content requirements, including the pleading details in LR23-PR00-2, but Fountain County does not publish a fill-in probate packet, checklist or estate information sheet for decedent estates.
Indiana also has no statewide court-approved probate form set for ordinary estate administration. The one statewide estate form identified for self-help users is the Coalition for Court Access small estate affidavit, CCA-EM-0722-5000. That affidavit is for qualifying estates with a gross probate estate, less liens, encumbrances and reasonable funeral expenses, of $100,000 for deaths after June 30, 2022 under IC 29-1-8. It is given to the bank or other holder of the asset, not filed with the Fountain Circuit Court.
Timeline
- At the opening filing, prepare pleadings that meet LR23-PR00-2 and file them with the Clerk's Office or through the Indiana E-Filing System if using e-filing.
- At appointment, address bond under LR23-PR00-3. Bond in an unsupervised estate is discretionary with the court, and bond in a supervised estate is generally required unless a local exception applies.
- Within 60 days after appointment in a supervised estate, file the inventory required by LR23-PR00-4.
- When selling real estate in a supervised estate, file the written appraisal required by LR23-PR00-5 unless it was filed with the inventory, and complete the sale within six months after the petition is filed or refile a current appraisal.
- If the estate remains open after one year, file the intermediate account required by LR23-PR00-7 within 30 days after that one-year point, and each year after while the estate remains open.
- Within 5 months and 15 days after first published notice, examine claims and allow or disallow them as required by LR23-PR00-10.
Local nuance
Fountain County-specific considerations
| Local issue | What it means in Fountain County |
|---|---|
| Only one trial court | Fountain County has no superior court, so estates are handled in the Fountain Circuit Court. The local question is not which court receives the case, but how the LR23-PR00 probate rules apply to the estate. |
| Local pleading content | LR23-PR00-2 requires each pleading to show attorney details when an attorney appears, and it states that the clerk will not prepare pleadings for a self-represented fiduciary or provide other estates' papers as models. |
| Bond is not automatic-free | LR23-PR00-3 allows bond decisions to remain with the court, especially in unsupervised estates, and generally requires bond in supervised estates unless a local exception applies. |
| Supervised-estate sales are document-heavy | LR23-PR00-5 and LR23-PR00-6 require appraisal support for supervised sales, plus a six-month sale window before a current appraisal must be refiled. |
| Unsupervised estates stay unsupervised unless changed | LR23-PR00-9 says the court enters no further administration orders in an unsupervised estate unless a petition asks that the estate be treated as supervised. Once that happens, the estate cannot switch back to unsupervised status under the local rule. |

Scenarios
| Persona | Likely Fountain County path | Where Sunset helps |
|---|---|---|
| Surviving spouse with co-owned home | Start by separating the co-owned home and beneficiary assets from assets titled only in the decedent's name. If letters are still needed, file in the Fountain Circuit Court and expect the local bond, notice and inventory rules to matter if the estate is supervised. | Sunset helps identify accounts, organize ownership details and prepare a county-ready packet for the Fountain Circuit Court. |
| Out-of-state adult child with small estate | If the Indiana small estate affidavit route fits, the statewide affidavit may avoid a Fountain County court administration. The ceiling is $100,000 for deaths after June 30, 2022 under IC 29-1-8, and the affidavit goes to the asset holder rather than the court. | Sunset helps determine whether the known assets fit the small-estate path and helps gather the institution details needed for transfer. |
| Parent settling predeceased child's estate, home must be sold | If a personal representative must sell Indiana real estate to pay debts or administration costs, the statewide timing rule in IC 29-1-7-15.1 can make early filing important. In a Fountain County supervised estate, LR23-PR00-5 also requires appraisal support and a six-month sale window. | Sunset helps organize the home, debt and heir information, then connects the family with local probate counsel when a court-supervised sale is likely. |

Probate counsel is especially useful in Fountain County when the estate is supervised, real estate must be sold, bond must be addressed, a nonresident personal representative is serving, creditors are active, or the family needs to comply with LR23-PR00 appraisal, inventory, accounting and fee-order rules. Frequently asked questions

File Fountain County estate papers with the Clerk's Office at the Fountain County Courthouse, 301 4th Street, Covington, IN 47932. The court hearing the estate is the Fountain Circuit Court.
Does Fountain County have a separate probate court?
No. Fountain County has no superior court and no separate court for estates. The Fountain Circuit Court is the trial court for probate matters in the county.
Can I e-file a Fountain County probate case?
Yes. Indiana estate case types can be filed through the Indiana E-Filing System. Attorneys file through the system. If you do not have a lawyer, Ind. Trial Rule 87 says unrepresented litigants are encouraged, but not required, to use the system.
What happens to the original will if the filing is electronic?
Ind. Trial Rule 87(E) requires a user filing a will for probate to file a complete copy of the will and an affidavit about the original. Unless the will has already been deposited with the clerk, the affiant keeps the original until the estate is closed and the personal representative is released, or until the will-contest period has expired, whichever is later, unless the court or statute directs otherwise.
Are there Fountain County probate forms?
Fountain County does not publish a fill-in probate packet for decedent estates. The local rules instead tell filers what pleadings must contain, especially LR23-PR00-2. How much does it cost to open an estate in Fountain County?
A petition for letters testamentary or letters of general administration is $177 under IC 33-37, current through the 2026 Legislative Session. Offering a will for probate alone carries no court costs fee under IC 33-37-4-7(c)(3).

Can I appear remotely for a Fountain County probate hearing?

Indiana courts may hold non-testimonial hearings remotely at the court's discretion, and testimonial hearings are in person unless good cause or party agreement supports a remote proceeding (Ind. Administrative Rule 14). Call the court line at (765) 793-3301 before assuming travel is unnecessary.
Do I have to travel to Covington to handle the estate?
Not always. Attorneys can file through the Indiana E-Filing System, MyCase can help you follow public case activity, and some steps may be handled by counsel without every family member traveling. If you are handling the matter without a lawyer, call the Clerk's Office at (765) 793-2192 or the court at (765) 793-3301 before making a trip.
