Before you file anything in Cass County, make a working list of the decedent's probate assets, nonprobate transfers, debts, funeral expenses and any real estate. Which court handles jurisdiction

Cass County is served by the courthouse in Logansport. The county has a Circuit Court and two standard Superior Courts, and the Clerk of the Circuit Court serves as the filing officer for those courts (IC 33-32-2-1).

Indiana venue is based on domicile: the probate of a will and the administration of an estate belong in the Indiana county where the decedent was domiciled at death (IC 29-1-7-1). If the decedent was domiciled in Cass County, start with the Cass County clerk even though the assigned court number should be checked with the clerk.

The jurisdiction process

  1. Collect the will, death certificate, asset list, creditor information and names and addresses of heirs, devisees and legatees. Decide whether you are asking for letters testamentary, letters of general administration, supervised administration or unsupervised administration.
  2. Prepare the petition and any supporting documents. Cass County does not publish a local probate packet or required local cover sheet, so use Indiana probate requirements and ask the clerk whether the assigned court has a preferred format.
  3. File with the Clerk of the Circuit Court at the Cass County Courthouse in Logansport. Because Cass County's case-allocation plan does not name estate cases, ask the clerk whether the estate will be docketed in the Circuit Court or one of the Superior Courts.
  4. Pay the required court costs for an administration petition. The amount for a petition opening administration is $177 in 2026 under Indiana's probate cost statutes (IC 33-37-4-7, IC 33-37-5). A will-only presentation is handled under IC 33-37-4-7(c)(3).
  5. If a will is e-filed, follow Ind. Trial Rule 87(E): file a complete copy of the will and the required affidavit about the original will, and retain the original unless the court or statute directs otherwise.
  6. After letters issue, publish the notice of administration once each week for two consecutive weeks and file proof of publication with the clerk within 30 days after publication, as Indiana requires (IC 29-1-7-7).
  7. Serve required notices on heirs, devisees, legatees and known creditors. Indiana claims rules use the statutory three-month and nine-month bars, so calendar notice and creditor deadlines carefully (IC 29-1-7-7, IC 29-1-14-1).
  8. Ask the assigned court whether any hearing can be handled remotely. In Indiana, non-testimonial hearings may be remote at the court's discretion, while testimonial hearings are generally in person unless good cause or party agreement supports remote participation (Ind. Administrative Rule 14).
  9. Once appointed, the personal representative uses the letters testamentary or letters of general administration as proof of authority to collect assets, deal with creditors and administer property (IC 29-1-10-4).
  10. Close the estate by the correct Indiana route, such as a closing statement in an unsupervised administration or the court-directed final settlement process in a supervised estate. This is the point where estate settlement work should match the inventory, accountings, distributions and creditor record.

Cass County's current local rules do not include an LR09-PR00 probate rule family, and no Cass County probate packet, checklist, cover sheet or prescribed local probate form is listed in the Cass County local materials described for this page.
