Before you begin — know the assets and liabilities
Before you file anything in Warren County, list the decedent's accounts, debts, vehicles, real estate, beneficiary designations and jointly owned property. Estate settlement is much easier when you know which assets actually need the Iowa District Court for Warren County and which assets pass outside probate.
Sunset searches across more than 2,300 financial institutions to help families find accounts and organize the estate settlement picture before a petition is prepared for the clerk in Indianola.
Which court handles jurisdiction
Probate for Warren County is filed with the clerk of the district court at the Warren County Justice Center in Indianola. That single clerk's office serves Warren County communities including Indianola, Carlisle and Norwalk.
Venue comes from Iowa Code 633.12. The district court of the county where the decedent lived at death has original and exclusive jurisdiction over the estate. If the decedent was not an Iowa resident, venue is in the county where the Iowa property is located or later brought. Warren County is part of Iowa's Fifth Judicial District, but the district is an administrative grouping. A Warren County probate case is filed in Indianola.
The jurisdiction process
- Gather the death certificate, the original will if there is one, asset information, creditor information and the names and addresses of heirs, devisees and known creditors. A person holding the will must deliver it to the court with jurisdiction over the estate (Iowa Code 633.285).
- Choose the Iowa route before filing. The affidavit for distribution of property under Iowa Code 633.356 may apply to personal property only, with no interest in real estate, after forty days, and reaches $100,000 effective July 1, 2026. Chapter 635 small estate administration is a court case with letters of appointment under Iowa Code 635.1 for estates within the $200,000 ceiling effective July 1, 2020. A will may also be admitted without administration under Iowa Code 633.31 and 633.305, or the estate may proceed under chapter 633.
- Prepare the petition and related papers. Warren County does not publish a local probate packet, and Iowa does not provide a statewide fill-in probate packet for decedent estates. If you are unsure which papers fit the estate, speak with an attorney before filing.
- Register and file through EDMS with the clerk of the district court for Warren County, unless you receive an exception under Iowa Ct. R. 16.302. A self-represented filer who cannot reasonably e-file should call 515-690-9260 and ask how to request a one-time paper exception or a case-long exception.
- Scan and e-file the original will if there is one. The filer keeps the paper original and must produce it if requested; after e-filing, the filer may submit the paper original to the clerk for non-electronic preservation (Iowa Ct. R. 16.411).
- After the court appoints a personal representative and the required oath and any bond issue are handled, the clerk issues the authority document. In a will case, that can be letters testamentary under Iowa Code 633. In a no-will case, that can be letters of administration under Iowa Code 633. In a chapter 635 small estate, the clerk issues letters of appointment under Iowa Code 635.1.
- Publish and mail notice. The personal representative publishes notice once each week for two consecutive weeks in a newspaper of general circulation published in Warren County and mails notice to known creditors. Testate estates also require notice to the surviving spouse, heirs and devisees whose identities are reasonably ascertainable (Iowa Code 633.230, 633.304).
- File the report and inventory with the Warren County clerk within 120 days after qualification unless the court grants more time (Iowa Code 633.361). Court costs for a decedent estate are then calculated under Iowa Code 633.31 as two-tenths of one percent (0.2%) of the probate assets listed in the report and inventory, plus statutory flat items.
- Track claims filed with the clerk. A claim is barred unless filed within the later of four months after the second publication or one month after mailed notice to that creditor, with the Medicaid rule stated separately in Iowa Code 633.410.
- Distribute and close. A chapter 635 small estate closes by closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through a final report and the court's order approving it and discharging the personal representative. A hearing is set only if an objection, a court order or a contested issue makes one necessary.
Forms and documents
Probate forms in Warren County
Warren County does not publish a local probate form, cover sheet or checklist for decedent estates. The clerk's office receives filings and can explain filing mechanics, but it cannot choose the probate route or draft papers for you.
Iowa also does not provide a statewide fill-in probate packet for decedent estate administration. A self-represented filer usually prepares the petition, notices, report and inventory and closing papers from the statute, or works with an attorney.

Local nuance
Warren County-specific considerations
| Local point | What it means for a Warren County filing |
|---|---|
| Use the Indianola filing office | Warren County is in the same Fifth Judicial District as Polk County, but probate filings for Warren County go to the clerk at the Warren County Justice Center in Indianola. |
| Use the Justice Center address | The filing office is at 115 N. Howard Street, Suite 100, Indianola, IA 50125. The county's general administration building is a different county office, not the probate filing counter. |
| Call before traveling | The county publishes building hours of 8:00 a.m. to 4:30 p.m., Monday through Friday. The clerk's separate filing cutoffs and lunch closures are not posted. |
| No local packet is posted | Warren County adds no local probate packet to Iowa's statewide requirements, so the filing should be prepared carefully before EDMS submission under Iowa Ct. R. 16.302. |
Recent updates
| Change | Current rule |
|---|---|
| Affidavit for distribution of property | The ceiling is $100,000 effective July 1, 2026, and the probate assets must consist only of personal property with no interest in real estate (Iowa Code 633.356). |
| Report and inventory timing | The report and inventory deadline is 120 days after qualification effective July 1, 2026, unless the court grants more time (Iowa Code 633.361). |
| Iowa inheritance tax | Iowa imposes no inheritance tax on estates of people who died on or after January 1, 2025 (Iowa Code 450.98). |
Scenarios
| Situation | Likely local path | Where Sunset helps |
|---|---|---|
| Surviving spouse with a co-owned home | Start with title and beneficiary designations before filing in Indianola. Joint tenancy property is outside the Iowa Code 633.31 probate-asset cost base, so a full estate filing may not be needed just because a home exists. | Sunset helps identify accounts, debts and title issues so the surviving spouse can see the estate settlement picture before starting a Warren County case. |
| Out-of-state adult child with a small estate | If the probate assets are personal property only and there is no interest in real estate, the Iowa Code 633.356 affidavit may work after forty days and reaches $100,000 effective July 1, 2026. If a court case is needed, chapter 635 small estate administration may apply within the $200,000 ceiling effective July 1, 2020 (Iowa Code 635.1). A nonresident personal representative needs a court order under Iowa Code 633.64. | Sunset helps the child work remotely, find accounts, organize balances and prepare questions for the Warren County clerk and a local attorney. |
| Parent settling predeceased child's estate, home must be sold | Real estate prevents use of the Iowa Code 633.356 affidavit. The estate will usually need letters from the clerk in Indianola and a court case before the property can be sold through the estate. | Sunset organizes the asset picture, prepares a probate packet with the Indianola filing details and connects the family with a local probate attorney for the sale. |

When to hire an attorney
Counsel makes sense in Warren County when the estate includes real estate to sell, a possible will contest, disputed creditor claims, an out-of-state fiduciary, uncertain title, or a family that is unsure whether the Iowa Code 633.356 affidavit, chapter 635 small estate administration, probate of a will without administration, or full chapter 633 administration fits. Iowa provides no fill-in probate packet for decedent estates, Warren County posts no local packet, and EDMS filing under Iowa Ct. R. 16.302 can be difficult for a first-time filer. Sunset connects to a vetted attorney.
