Before you begin — know the assets and liabilities

Before opening probate in Mitchell County, make a first list of the assets, debts, named beneficiaries and real estate. That inventory shapes the estate settlement route, the notices that must be sent, and the court costs that will be calculated later from the report and inventory.

Sunset can help the family look for accounts and assets across more than 2,300 institutions before the petition is prepared. That makes the Mitchell County estate settlement packet more complete before you work through EDMS or ask the Osage clerk about a filing exception.

Which court handles jurisdiction

Probate for Mitchell County is filed with the clerk of the district court at the Mitchell County Courthouse, 212 S. 5th Street, Osage, IA 50461. The case is in the Iowa District Court for Mitchell County, which sits in Iowa's Second Judicial District.

The district number does not move the filing to another county. Iowa Code 633.12 gives the district court of the county where the decedent resided at death jurisdiction over the estate. For a nonresident decedent, venue is in the county where Iowa property is located or later brought.

The jurisdiction process

  1. Collect the death certificate, the original will if there is one, asset information, debt information and contact information for heirs, devisees and known creditors.
  2. If someone has the will after learning of the death, deliver it to the court with jurisdiction over the estate as required by Iowa Code 633.285.
  3. Choose the correct Iowa route before filing: the affidavit for distribution of property under Iowa Code 633.356 if it fits, small estate administration under chapter 635, probate of a will without administration, or full administration under chapter 633.
  4. Register to file through EDMS, or ask the Mitchell County clerk how to request a one-time or case-long paper filing exception under Iowa Ct. R. 16.302.
  5. E-file the petition with the clerk of the district court for Mitchell County. If there is an original will, scan and e-file it, keep the paper original, and submit it to the clerk for preservation if appropriate under Iowa Ct. R. 16.411.
  6. After the required oath and any required bond, the clerk issues the authority document. In a chapter 633 estate, that may be letters testamentary or letters of administration under Iowa Code 633. In a chapter 635 small estate, the clerk issues letters of appointment under Iowa Code 635.1.
  7. Publish and mail the required notices. Iowa notice rules require publication once each week for two consecutive weeks and mailing to known creditors, and in a testate estate to the surviving spouse, heirs and devisees whose identities are reasonably ascertainable.
  8. File the report and inventory within 120 days after qualification unless the court grants more time, as provided by Iowa Code 633.361. Iowa Code 633.31 then uses 0.2% of the probate assets listed in the report and inventory for court costs.
  9. Track claims filed with the clerk. Under Iowa Code 633.410, claims are barred unless filed by the later of four months after the second publication of notice or one month after mailed notice to a reasonably ascertainable creditor.
  10. Distribute property only when the estate is ready. A chapter 635 small estate closes through a closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through a final report and the court's order approving it and discharging the personal representative.
  11. If a hearing is set, ask the Mitchell County clerk how that judge handles scheduling. Iowa probate is often handled on the papers, but contested matters, objections or court orders can require a hearing, and a request for remote appearance is handled by motion under Iowa Ct. R. 15.302.

Scenarios

ScenarioLocal pathWhere Sunset helps
Surviving spouse w/ co-owned homeStart by reviewing title to the home. Joint tenancy property is outside the Iowa Code 633.31 court-cost base. If a Mitchell County filing is needed, it is filed through EDMS with the clerk of the district court in Osage under Iowa Ct. R. 16.302.Sunset helps identify accounts, title clues and beneficiary designations before the spouse decides whether a court filing is needed for estate settlement.
Out-of-state adult child w/ small estateIf the property fits Iowa Code 633.356, the affidavit for distribution of property is presented to the holder rather than filed with the clerk. If real estate is involved or a personal representative is needed, the child should ask counsel about chapter 635 and about the court-order route for a nonresident personal representative.Sunset helps gather the asset list, locate institutions and connect the child with Iowa counsel when a court case or nonresident appointment is needed.
Parent settling predeceased child's estate, home must be soldA home to sell means the affidavit route is not enough. The parent should expect a Mitchell County court case, letters of administration under Iowa Code 633 if there is no will, and court costs based on the report and inventory under Iowa Code 633.31.Sunset helps organize the estate settlement file, prepare the probate packet and find a local attorney when real estate must be sold.
