Before you begin — know the assets and liabilities
Before you file anything in Calhoun County, list the assets, debts, account holders, beneficiary designations and real estate connected to the person who died. That first inventory drives the estate settlement route, the need for letters, the court cost calculation under Iowa Code 633.31 and whether a courthouse filing is needed at all.
Sunset's 2,300-institution asset discovery helps families look for accounts before choosing a probate path. In a small rural county like Calhoun County, that preparation can save a trip to Rockwell City and helps you ask the clerk or an attorney the right questions.
Which court handles jurisdiction
Probate for Calhoun County is filed with the clerk of the district court at the Calhoun County Courthouse, 416 4th Street, Rockwell City, in the Iowa District Court for Calhoun County. The court sits in Iowa's Second Judicial District, but the district does not move the filing counter out of Calhoun County.
Venue follows Iowa Code 633.12. If the decedent lived in Calhoun County at death, the Calhoun County district court has jurisdiction to administer the estate. If the decedent was not an Iowa resident, venue is tied to property in Calhoun County or property later brought into the county.
The jurisdiction process
- Gather the death certificate, the original will if one exists, account statements, debt information and real estate information. Anyone who has the will after learning of the death must deliver it to the court with jurisdiction over the estate under Iowa Code 633.285.
- Choose the Iowa route before filing. Some personal-property estates use the affidavit under Iowa Code 633.356 without opening a court case. Some estates use chapter 635 small estate administration. A will may sometimes be probated without administration under Iowa Code 633.31 and Iowa Code 633.305. Other estates proceed under chapter 633.
- Register for EDMS or ask about an exception. Iowa Ct. R. 16.302 requires electronic filing for self-represented filers as well as attorneys. If you cannot reasonably file electronically, ask the Calhoun County clerk about a one-time paper exception or the process for requesting a case-long exception by court order.
- E-file the petition with the clerk of the district court for Calhoun County. The filing office is at the Calhoun County Courthouse, 416 4th Street, Rockwell City. If there is an original will, scan and e-file it; after e-filing, the filer may submit the paper original to the clerk for non-electronic preservation under Iowa Ct. R. 16.411.
- After the court grants the requested authority and the required oath and any bond are handled, the clerk issues the authority document. In a chapter 633 estate, that can be letters testamentary or letters of administration under Iowa Code 633. In a chapter 635 estate, the clerk issues letters of appointment under Iowa Code 635.1.
- Give notice. After letters issue, the personal representative publishes notice once each week for two consecutive weeks in a newspaper of general circulation in the county where the estate is pending and mails notice to known creditors. In a will case, notice also goes to the surviving spouse, heirs and devisees whose identities are reasonably ascertainable.
- File the report and inventory. Iowa Code 633.361 requires the report and inventory within 120 days after qualification unless the court allows more time. The Iowa Code 633.31 court cost is based on the probate assets listed in that report and inventory.
- Handle claims, assets and taxes. Claims must be filed with the clerk within the later of four months after the second publication or one month after notice was mailed to that claimant under Iowa Code 633.410. Most administration work is handled on the papers, but the court can set a hearing when an objection, contested matter or court order requires one.
- Distribute and close the estate. A chapter 635 small estate closes by a closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through a final report and the court's order approving the report and discharging the personal representative.

Local nuance
Calhoun County-specific considerations
| Local point | What it means |
|---|---|
| One filing counter in Rockwell City | Calhoun County probate is filed with the clerk of the district court at the Calhoun County Courthouse, 416 4th Street. Iowa's Second Judicial District groups judges and administration, but it does not move Calhoun County probate filings to another county. |
| Fax and email are contact channels, not filing channels | The clerk publishes fax 712-201-5033 and email [email protected]. Iowa filings still go through EDMS under Iowa Ct. R. 16.302 unless an exception is granted. |
| Call before travelling | The courthouse building hours are Monday through Friday, 8:30 a.m. to 4:30 p.m. The clerk's own counter hours, any lunch closure and any filing cutoff are not separately published. |
| No local probate paperwork | Calhoun County publishes no local probate form, cover sheet or checklist. Ask the clerk what the Rockwell City counter wants with a filing. |
| Do not confuse the recorder with the clerk | The Calhoun County Recorder is a separate land-records office in the same courthouse. Probate filings go to the clerk of the district court, not to the recorder. |
Recent updates
| Change | What families should know |
|---|---|
| Affidavit for distribution of property | The Iowa Code 633.356 affidavit ceiling is $100,000, effective July 1, 2026. It applies only when the probate assets consist only of personal property and there is no interest in real estate. |
| Report and inventory deadline | The report and inventory deadline is 120 days after qualification under Iowa Code 633.361, effective July 1, 2026, the same effective date used for the Iowa Code 633.356 affidavit update. |
| Iowa inheritance tax | No Iowa inheritance tax applies to the estate of a person who died on or after January 1, 2025, under Iowa Code 450.98. A death before that date can raise older tax questions. |
Scenarios
| Situation | Likely path in Calhoun County | Where Sunset helps |
|---|---|---|
| Surviving spouse with a co-owned home | Start with title. Joint tenancy property is outside the Iowa Code 633.31 court cost base. If an estate still needs to be opened, file through EDMS with the clerk of the district court in Rockwell City. | Sunset helps identify accounts, real estate and beneficiary designations so the spouse can see whether a probate filing is needed before spending time on an estate settlement step. |
| Out-of-state adult child with a small estate | If there is no real estate interest and the assets fit the Iowa Code 633.356 affidavit route, the affidavit is presented to the holder of the property rather than filed with the clerk. If real estate is involved, the case usually needs chapter 635 or chapter 633 administration in Rockwell City. | Sunset helps the child work from outside Iowa, organize account information and prepare questions for the Calhoun County clerk or a probate attorney. |
| Parent settling predeceased child's estate, home must be sold | The Iowa Code 633.356 affidavit route is not available when real estate must be sold. The estate needs a Calhoun County court case, letters from the clerk and administration through EDMS. | Sunset builds the asset picture, supports estate settlement organization and connects the family with a local probate attorney for the sale and court filings. |

When to hire an attorney
Iowa does not provide a statewide probate form packet for decedent estates, and Calhoun County does not add a local packet or checklist. Counsel makes sense when the estate includes real estate to sell, a disputed claim, a possible will contest, an insolvent estate, tax questions for an older death or an out-of-state personal representative. The clerk has real statutory responsibilities in Iowa probate but cannot give legal advice or choose the estate settlement route. Sunset connects families with a vetted attorney.
