Before you begin — know the assets and liabilities

Before you file anything in Plymouth County, identify the assets, debts, beneficiaries, and whether the decedent owned real estate. That first inventory shapes the estate settlement path, the need for letters, and whether the clerk in Le Mars is involved at all.

Sunset's estate settlement platform helps families search across more than 2,300 institutions for accounts and assets, then organize what was found before a petition, notice, or report and inventory is prepared.

Which court handles jurisdiction

Probate for Plymouth County is filed with the clerk of the district court at the Plymouth County Courthouse, 215 4th Avenue SE, Le Mars. The same courthouse serves Plymouth County filings unless the clerk directs otherwise.

Venue follows Iowa Code 633.12. If the decedent lived in Plymouth County at death, the estate is administered in the Iowa District Court for Plymouth County. If the decedent was not an Iowa resident, the Iowa county where the property is located, or where property is later brought, is the filing county.

Plymouth County is in Iowa's Third Judicial District. That district is an administrative grouping of courts and judges. It does not move a Plymouth County probate filing to Sioux City or any other county.

The jurisdiction process

  1. Gather the death certificate, the original will if there is one, a list of assets and debts, and contact information for heirs, devisees, and known creditors. Anyone holding the will after learning of the death must deliver it to the court that has jurisdiction over the estate (Iowa Code 633.285).
  2. Choose the Iowa route before filing. If the estate qualifies for the affidavit for distribution of property, the affidavit is presented to the property holder after forty days and without letters, but only when Iowa Code 633.356 applies, including the $100,000 ceiling effective July 1, 2026. If a court case is needed, the filing is made in Le Mars through EDMS.
  3. Register for EDMS or ask the Plymouth County clerk about a good-cause paper exception. EDMS is required for self-represented filers as well as attorneys, and exceptions are handled under Iowa Ct. R. 16.302.
  4. E-file the petition with the clerk of the district court for Plymouth County. If there is an original will, scan and e-file it, keep the paper original, and ask the clerk whether to submit it for non-electronic preservation under Iowa Ct. R. 16.411.
  5. After the court appoints the personal representative and the required oath and any required bond are handled, the clerk issues letters testamentary or letters of administration in a chapter 633 estate, or letters of appointment for administration in a chapter 635.1 small estate.
  6. Publish notice once each week for two consecutive weeks in a newspaper of general circulation published in Plymouth County, and mail the required notices to known creditors and the people entitled to notice under Iowa Code 633.230 or Iowa Code 633.304.
  7. File the report and inventory with the clerk within 120 days after qualification unless the court grants more time (Iowa Code 633.361). Court costs are assessed under Iowa Code 633.31 on the probate assets listed in the report and inventory.
  8. Track creditor claims filed with the clerk. Claims are barred unless filed by the later of four months after the second publication or one month after mailed notice to that creditor, with the Medicaid rule stated in Iowa Code 633.410.
  9. Administer and distribute the estate. A chapter 635 estate closes by closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through a final report and the court's order approving it and discharging the personal representative.

Plymouth County-specific considerations

Email and fax are contact tools, not filing channelsPlymouth County lists [email protected] and fax 712-546-8430, but Iowa probate filings go through EDMS unless an exception applies under Iowa Ct. R. 16.302.
