Before you begin — know the assets and liabilities

Before you open a Pocahontas County probate case, identify what the person owned, what passed by beneficiary designation or joint tenancy, and what debts are known. That inventory drives the estate settlement route, the need for letters, and whether a court case is needed at all.

Sunset searches across more than 2,300 financial institutions to help families find accounts, insurance, retirement assets and debts before filing. That asset picture helps you decide what to ask the Pocahontas County clerk, what to prepare for EDMS filing, and when a lawyer should be involved.

Which court handles jurisdiction

Probate for Pocahontas County is filed with the clerk of the district court at the Pocahontas County Courthouse, 99 Court Square, in the city of Pocahontas. The case belongs in the Iowa District Court for Pocahontas County, which sits in Iowa's Second Judicial District.

Iowa venue is county-based. The district court of each county has original and exclusive jurisdiction to administer the estate of a person who resided in that county at death, and a nonresident estate is filed where Iowa property is located or later brought into the county (Iowa Code 633.12). Sharing the Second Judicial District with other counties does not move a Pocahontas County probate filing to another courthouse.

The jurisdiction process

  1. Gather the death certificate, the original will if there is one, a first list of assets and debts, and contact information for the surviving spouse, heirs, devisees and known creditors. Anyone holding the will after learning of the death must deliver it to the court with jurisdiction over the estate (Iowa Code 633.285).
  2. Decide which Iowa route fits before filing in Pocahontas County. The affidavit for distribution of property under Iowa Code 633.356 is not filed with the clerk and does not produce letters. A chapter 635 small estate, probate of a will without administration, or full chapter 633 administration is filed with the clerk of the district court.
  3. Register for EDMS or ask about an exception before preparing a Pocahontas County filing. Iowa requires EDMS for self-represented filers as well as lawyers, but a one-time paper filing or a case-long exception can be allowed for good cause under Iowa Ct. R. 16.302.
  4. E-file the petition and supporting documents with the clerk of the district court for Pocahontas County. If there is a will, scan and e-file it, keep the paper original as required, and ask the clerk whether to submit the paper original for preservation under Iowa Ct. R. 16.411.
  5. After the required oath and any required bond, the clerk issues the appropriate authority document. In a chapter 633 estate, that may be letters testamentary or letters of administration after the court acts under chapter 633. In a chapter 635 small estate, the clerk issues letters of appointment under Iowa Code 635.1.
  6. Give notice after letters issue. The personal representative publishes notice once each week for two consecutive weeks in a newspaper of general circulation published in Pocahontas County and mails required notices to known creditors, the surviving spouse, heirs and devisees as applicable (Iowa Code 633.230, 633.304).
  7. File the report and inventory with the clerk. The report and inventory is due within 120 days after qualification unless the court allows more time (Iowa Code 633.361). Iowa court costs are then based on 0.2% of the probate assets listed in the report and inventory, plus statutory flat items where they apply (Iowa Code 633.31).
  8. Handle claims filed with the clerk. A claim is barred unless it is filed by the later of four months after the second publication of notice or one month after notice was mailed to a reasonably ascertainable creditor, with the Medicaid rule stated separately in Iowa Code 633.410.
  9. Distribute assets only after authority, notice, claims and court-cost issues are handled. If a hearing is needed because someone objects or the court orders one, ask the clerk how Pocahontas County sets the matter and, if needed, file a motion for remote participation under Iowa Ct. R. 15.302.
  10. Close the estate. A chapter 635 estate closes by closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through a final report and the court's order approving the report and discharging the personal representative.

Forms and documents

Scenarios

SituationLikely Pocahontas County pathWhere Sunset helps
Surviving spouse with a co-owned homeStart with title to the home. Joint tenancy property is outside the probate-asset cost base under Iowa Code 633.31, so a court estate may not be needed for that asset. If an estate is needed, file through EDMS with the Pocahontas County clerk.Sunset finds accounts and assets first, so the spouse can see whether estate settlement requires a filing or whether assets pass outside probate.
Out-of-state adult child with a small estateIf the estate has only personal property and no interest in real estate, the Iowa Code 633.356 affidavit may be presented to the holder of the property rather than filed in Pocahontas County. If a court estate is needed, EDMS filing and any nonresident fiduciary questions should be discussed with counsel.Sunset can work with the child from anywhere, organize the asset list, and prepare questions for the Pocahontas County clerk before anything is mailed or e-filed.
Parent settling a predeceased child's estate, home must be soldThe affidavit route is not used when the decedent had an interest in real estate. The estate usually needs a Pocahontas County court case, authority from the clerk, and court costs based on the probate assets in the report and inventory under Iowa Code 633.31.Sunset assembles the estate settlement picture, generates a probate packet using the Pocahontas County filing details, and connects the family with a probate attorney for the sale and closing steps.

When to hire an attorney

Iowa does not provide a statewide probate packet for administering a decedent's estate, and Pocahontas County does not add a local form set. Sunset connects families with a vetted attorney.
