The jurisdiction process

  1. Gather the death certificate, the original will if there is one, asset information and debt information. A person holding the will must deliver it to the court that has jurisdiction of the estate (Iowa Code 633.285).
  2. Choose the route before filing. Iowa has a no-court affidavit route under Iowa Code 633.356 for qualifying personal property only, small estate administration under Iowa Code 635, probate of a will without administration, and full administration under Iowa Code 633.
  3. Register for EDMS filing under Iowa Ct. R. 16.302. If you cannot reasonably file electronically, call the Carroll clerk at (712) 792-4327 and ask how to request a one-time paper exception or a case-long exception by court order.
  4. E-file the petition with the clerk of the district court for Carroll County. If there is an original will, scan and e-file it. After e-filing, the filer may give the paper original to the clerk for non-electronic preservation under Iowa Ct. R. 16.411.
  5. After the required oath and any required bond, the clerk issues the appropriate authority papers. In a chapter 635 small estate, the clerk issues letters of appointment under Iowa Code 635.1. In a chapter 633 estate, the clerk issues letters after the court's order under Iowa Code 633.178.
  6. Publish notice once each week for two consecutive weeks in a newspaper of general circulation published in Carroll County, and mail required notices to known creditors and other required recipients under Iowa Code 633.230 or Iowa Code 633.304.
  7. File the report and inventory with the Carroll clerk within 120 days after qualification unless the court grants more time (Iowa Code 633.361).
  8. Expect court costs under Iowa Code 633.31, including 0.2% of the probate assets listed in the report and inventory plus statutory flat items. The clerk can explain payment procedure but cannot choose a filing route for you.
