Iowa venue comes from Iowa Code 633.12. The district court of the county handles estates of people who resided in that county, or resided there at death. For a nonresident who leaves Iowa property, venue is in the county where the property is located or later brought. Grundy County is part of Iowa's First Judicial District, but that district grouping does not move the filing to Waterloo, Dubuque, or another county seat.
The jurisdiction process
- Gather the death certificate, the original will if one exists, asset information, debts and names of heirs and beneficiaries. Anyone holding the will after learning of the death must deliver it to the court with jurisdiction under Iowa Code 633.285.
- Choose the Iowa route before filing. The affidavit for distribution of property under Iowa Code 633.356 is outside the court case and, effective July 1, 2026, is for probate assets consisting only of personal property with no interest in real estate and a gross value of $100,000 or less. Chapter 635 small estate administration is a court case for qualifying estates whose probate assets do not exceed $200,000 under Iowa Code 635.1, effective July 1, 2020. Other estates generally use chapter 633 administration, and some wills may be admitted without administration under Iowa Code 633.31 and 633.305.
- Register for EDMS before filing, because Iowa Ct. R. 16.302 requires electronic filing for attorneys and self-represented filers. If you cannot reasonably use EDMS, call the Grundy County clerk at 319-824-5229 while the office is open to ask how to request a one-time paper filing exception or a case-long exception by court order under Iowa Ct. R. 16.302.
- E-file the petition with the clerk of the district court for Grundy County. The original will is scanned and e-filed; the filer keeps the paper original and must provide it if requested, and may submit it to the clerk for non-electronic preservation after e-filing under Iowa Ct. R. 16.411.
- After the required oath and any required bond, the clerk issues the applicable authority document. In an Iowa estate, notice is published once a week for two consecutive weeks in a newspaper of general circulation in the county where the estate is pending and mailed to known creditors. In a testate estate, notice also goes to the surviving spouse, heirs and devisees whose identities are reasonably ascertainable.
- Use Grundy County's local creditor forms when they fit the filing. A creditor asserting a claim may use the county's Claim in Probate form, and a resolved claim may use the Release of Claim in Probate form. These forms do not replace the petition, report and inventory, or notices.
- File the report and inventory with the Grundy County clerk. The deadline is 120 days after qualification under Iowa Code 633.361. Decedent-estate court costs are calculated under Iowa Code 633.31, including 0.2% of the probate assets listed in the report and inventory.
- Handle creditor claims through the clerk in Grundy Center. Under Iowa Code 633.410, claims are barred unless filed by the later of four months after the second publication of notice or one month after mailed notice to a reasonably ascertainable creditor.
- Distribute and close the estate. A chapter 635 small estate closes by closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through the final report and the court's order approving the report and discharging the personal representative.
