Venue follows Iowa Code 633.12. A Clinton County probate belongs in Clinton County if the decedent lived there at death. If the decedent was not an Iowa resident, Clinton County is the proper county when the Iowa property subject to administration is in Clinton County or is later brought there.

The jurisdiction process
- Gather the death certificate, the asset and debt list, and the original will if one exists. A person who has custody of the will after learning of the death must deliver it to the court with jurisdiction over the estate (Iowa Code 633.285).
- Choose the Iowa route before filing. The affidavit for distribution of property under Iowa Code 633.356 can be used, effective July 1, 2026, for $100,000 or less of personal property only, with no interest in real estate, after forty days and when no administration is pending. Small estate administration under Iowa Code 635.1 applies, effective July 1, 2020, when probate assets are $200,000 or less. Other estates proceed under Iowa Code 633, and a will may sometimes be probated without administration under Iowa Code 633.31 and Iowa Code 633.305.
- Register for EDMS before filing, unless you are asking for an exception. Iowa requires EDMS electronic filing for self-represented filers as well as attorneys, and Iowa Ct. R. 16.302 explains the one-time and case-long exceptions.
- E-file the petition with the clerk of the district court for Clinton County. The filing office is at 612 North 2nd Street in Clinton, with mail to P.O. Box 2957, Clinton, IA 52732.
- If there is a will, scan and e-file it. Iowa Ct. R. 16.411 allows the filer to keep the paper original and produce it on request, and the filer may give the paper original to the clerk afterward for preservation.
- After the required oath or certification and any required bond, authority is issued through the clerk. In an Iowa Code 633 estate, letters testamentary or letters of administration are issued under Iowa Code 633.178. In a small estate, the clerk issues letters of appointment for administration under Iowa Code 635.1.
- Give notice. The personal representative publishes notice once each week for two consecutive weeks in a newspaper of general circulation in Clinton County and mails notice to known creditors. In a testate estate, notice also goes to the surviving spouse, heirs and devisees whose identities are reasonably ascertainable (Iowa Code 633.230, 633.304).
- File the report and inventory with the Clinton County clerk. The report and inventory is due within 120 days after qualification unless the court grants more time (Iowa Code 633.361). Court costs are then based on 0.2% of the probate assets listed in the report and inventory, plus statutory flat items (Iowa Code 633.31).
- Track creditor claims. Claims are filed with the clerk and are barred unless filed by the later of four months after the second publication or one month after mailed notice to a reasonably ascertainable creditor (Iowa Code 633.410).
- Distribute and close. A small estate closes by closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through the final report and the court's order approving the report and discharging the personal representative.
