The Iowa District Court for Buena Vista County has probate jurisdiction for estates of people who were Buena Vista County residents at death, and for nonresidents with Iowa property in Buena Vista County (Iowa Code 633.12). Buena Vista County is in Iowa's Third Judicial District, but that district does not move the filing counter to Sioux City, Sioux County, O'Brien County or any other county seat.

The jurisdiction process

  1. Collect the death certificate, the original will if there is one, asset information, debt information and names and addresses for interested people. Anyone holding the will after learning of the death must deliver it to the court with jurisdiction over the estate (Iowa Code 633.285).
  2. Decide which Iowa route fits before filing. The Iowa Code 633.356 affidavit may be used only for personal property with no interest in real estate, after forty days have passed, and the current ceiling is $100,000 effective July 1, 2026. Chapter 635 small estate administration is a court case for qualifying estates, with a $200,000 ceiling effective July 1, 2020 (Iowa Code 635.1). A will can also be admitted without administration, or a full chapter 633 administration can be opened.
  3. Register for EDMS before filing, or ask the Storm Lake clerk how to request an exception if electronic filing is not reasonably available to you (Iowa Ct. R. 16.302). Call 712-749-2546 if you need local filing directions.
  4. E-file the petition with the clerk of the district court for Buena Vista County. The original will is scanned and e-filed; after e-filing, the filer may submit the paper will to the clerk for preservation under Iowa Ct. R. 16.411.
  5. After the required oath and any required bond, authority issues from the clerk. In a chapter 633 estate the clerk issues letters testamentary or letters of administration after the court's order (Iowa Code 633.178). In a chapter 635 small estate, the clerk issues letters of appointment for administration (Iowa Code 635.1).
  6. Publish and mail the required notices. Iowa notice is published once each week for two consecutive weeks in a newspaper of general circulation in the county where the estate is pending, and known creditors and required family or devisee contacts receive mailed notice under the applicable Iowa Code 633 notice provisions.
  7. File the report and inventory within 120 days after qualification unless the court gives more time (Iowa Code 633.361). Iowa Code 633.31 then uses 0.2% of the probate assets listed in the report and inventory, plus statutory flat items, for decedent estate court costs.
  8. Track creditor claims. A claim is barred unless filed with the clerk by the later of four months after the second publication of notice or one month after notice was mailed to that creditor, with the Medicaid recovery rule handled separately (Iowa Code 633.410).
  9. Administer, distribute and close the estate. A chapter 635 small estate closes by closing statement and clerk discharge under Iowa Code 635.8. A chapter 633 estate closes through the final report and the court's order approving it and discharging the personal representative.
  10. If a hearing is set, ask the Storm Lake clerk how that matter is handled locally. Most Iowa probate work is handled on the papers, but a contested issue, objection or court order can require a hearing, and any request to appear remotely is handled under Iowa Ct. R. 15.302.
