Before you begin — know the assets and liabilities
Before you file anything in Wallingford, list the assets, debts, accounts, beneficiary designations and any real estate connected to the estate. Connecticut estate settlement depends on what passed through probate, what passed outside probate, and what still must be reported to the Probate Court.
Sunset's asset discovery checks more than 2,300 institutions to help families find accounts before choosing the correct estate settlement path. That inventory work matters in Wallingford because the court's later fee is based on estate value under C.G.S. section 45a-107, not on a payment made when the first petition is filed.
Which court handles jurisdiction
Connecticut probate is handled by a separate statewide system of 54 Probate Courts, one for each probate district, not by the Superior Court and not by any county (C.G.S. section 45a-2). The Wallingford Probate Court serves the town of Wallingford, and the courthouse is also in Wallingford at Town Hall, Room 114.
If the decedent was domiciled in Wallingford at death, the estate is filed at the Wallingford Probate Court. For a will, the executor applies to the Probate Court of the district where the testator was domiciled at death, within thirty days after death (C.G.S. section 45a-283). For an intestate estate, the Probate Court of the district where the decedent was domiciled at death has jurisdiction to grant letters of administration (C.G.S. section 45a-303). For a nonresident who owned Connecticut property, C.G.S. section 45a-287 gives the possible districts.
If the person lived somewhere other than Wallingford, use the statewide Court Locator at ctprobate.gov/court-locator before filing. A decision of the Probate Court may be appealed to the Superior Court, generally within thirty days (C.G.S. section 45a-186).
The jurisdiction process
- Choose the correct opening papers. For a full Wallingford estate, the opening petition is PC-200, Petition/Administration or Probate of Will, filed under C.G.S. section 45a-283 for a will. If the C.G.S. section 45a-273 affidavit in lieu process applies, use PC-212 with the related confidential information form.
- File with the Wallingford Probate Court. File at Wallingford Town Hall, 45 South Main Street, Room 114, Wallingford, CT 06492, or use the statewide eFiling system if you are eligible. The Connecticut Probate Courts run one statewide eFiling system, powered by TurboCourt. Attorneys who appear in a probate matter must register for it under Probate Court Rules of Procedure, section 22.1. Registration is optional for everyone else, and a self-represented party may open an Individual account and file at the Wallingford Probate Court that way. The original will can never be eFiled and must reach the court on paper under section 7.1a.
- Do not bring an opening payment for a decedent estate. No filing fee is due when a decedent's estate is opened. The Wallingford Probate Court invoices a statutory fee later, computed on the value of the estate under C.G.S. section 45a-107. For a person who died on or after July 1, 2016, the fee is graduated on the greater of the inventory, the gross estate or the Connecticut taxable estate, running from $25 up to a cap of $40,000, with a minimum of $150 where a full estate is opened on a basis under $10,000, and with any portion passing to a surviving spouse counted at half (C.G.S. section 45a-107). The fee is the same in all Connecticut probate districts under C.G.S. section 45a-105.
- Watch for notice and hearing instructions. The court may schedule a hearing, accept waivers, or use the streamline notice process under Probate Court Rules of Procedure, section 8.6. Connecticut Probate Courts may allow a party, witness or attorney to take part in a hearing, conference or deposition by electronic means. Section 66.1 of the Probate Court Rules of Procedure lets the court permit it on request or on its own motion, weighing factors that include the nature of the proceeding, the technology available, and whether remote participation would still allow full examination of witnesses. It is a request the court decides, not a right, and the rule names no platform. Ask the clerk of the Wallingford Probate Court what that court expects.
- Receive authority from the clerk after appointment. When the Probate Court appoints you, the court's clerk issues a certificate of your appointment as fiduciary. Under C.G.S. section 45a-200 that certificate is sufficient evidence of your authority and identity for one year from the date it is issued, so a bank or transfer agent may ask for a recently issued copy. Ask the clerk of the Wallingford Probate Court for as many certified copies as you expect to need, and expect to request fresh ones if the estate stays open past a year.
- Administer the estate after appointment. The court places newspaper notice to creditors within 14 days after appointment of the first fiduciary (C.G.S. section 45a-354). File the inventory on PC-2407 within two months after qualification unless the court extends the time for cause under C.G.S. section 45a-341. Creditors generally have 150 days to present claims (C.G.S. section 45a-356), and the return of claims on PC-237 is due within 60 days after that period ends (C.G.S. section 45a-361). The Connecticut estate tax return is filed within six months of death.
- Close the estate. When administration is complete, file the financial report on PC-246 under Probate Court Rules of Procedure, section 30.19, or the account the court requires. If the court directs an affidavit of closing, file PC-213 under Probate Court Rules of Procedure, section 36.12 after distribution. If a party is aggrieved by a decree, the appeal goes to the Superior Court under C.G.S. section 45a-186.
Forms and documents
Probate forms at the Wallingford Probate Court
Connecticut probate forms are statewide. The Wallingford Probate Court uses the same numbered PC forms as every other Connecticut Probate Court, published free by the Office of the Probate Court Administrator at ctprobate.gov. The court does not publish forms of its own.
| Form | Use in Wallingford estate settlement |
|---|---|
| PC-200 | Petition/Administration or Probate of Will, used to open a full decedent estate under C.G.S. section 45a-283. |
| PC-212 | Affidavit in Lieu of Probate of Will/Administration, used for the C.G.S. section 45a-273 procedure. |
| PC-2407 | Inventory/Decedents' Estates, filed under C.G.S. section 45a-341. |
| PC-237 | Return of Claims and List of Notified Creditors, filed under C.G.S. section 45a-361. |
| PC-246 | Financial Report/Decedent's Estate, the common closing report under Probate Court Rules of Procedure, section 30.19. |
| PC-213 | Affidavit of Closing, filed when the court directs it under Probate Court Rules of Procedure, section 36.12. |
| PC-482 | Appointment of Probate Judge as Agent for Service by Non-Resident Fiduciary, used when a fiduciary lives outside Connecticut. |
| CT-706 NT | Connecticut estate tax return for nontaxable estates, filed with the Probate Court within six months when that form applies. |
For real estate, the Notice for Land Records/Appointment of Fiduciary is obtained from the court and filed with the town clerk within two months of appointment. Do not cite C.G.S. section 45a-341 for that land records step, because that statute governs the inventory.

Scenarios
| Situation | Likely Wallingford path | Where Sunset helps |
|---|---|---|
| Surviving spouse with co-owned home | If the decedent was domiciled in Wallingford, start with the Wallingford Probate Court under C.G.S. section 45a-283. A jointly held home may pass outside probate, but the Connecticut estate tax return is still filed with the Probate Court within six months, and the later probate fee is computed under C.G.S. section 45a-107. | Sunset helps identify jointly owned accounts, beneficiary assets and debts so the spouse can see what belongs in probate and what still affects estate settlement. |
| Out-of-state adult child with small estate under C.G.S. section 45a-273 | Papers may be mailed to Wallingford Town Hall, 45 South Main Street, Room 114, Wallingford, CT 06492. The original will must travel on paper under Probate Court Rules of Procedure, section 7.1a. A fiduciary who lives outside Connecticut may need PC-482. | Sunset helps gather account information, generate the Wallingford packet and identify when local attorney help would save travel or prevent a rejected filing. |
| Parent settling predeceased child's estate, home must be sold | A sale of solely owned real estate means full administration through PC-200 under C.G.S. section 45a-283. The clerk's certificate of appointment under C.G.S. section 45a-200 is the proof a title company will expect, and it is good for one year. A contested decree is appealed to the Superior Court under C.G.S. section 45a-186. | Sunset helps organize the asset list, assemble probate forms and connect the family with a Wallingford-area probate attorney when real estate, title or disputes make the process harder. |
